Rules of Guangzhou Municipality on the Supervision and Management of Gas Cylinder Safety
(Issued on February 19, 2024in accordance with Decree No. 206 of the People's Government of Guangzhou Municipality and put into effect on April 1, 2024)
Article 1 These Rules are formulated in accordance with the provisions of Special Equipment Safety Law of the People’s Republic of China, Regulations on the Safety Management of Hazardous Chemicals, Regulations on Urban Gas Management, Regulations of Guangdong Province on Special Equipment Safety, Regulations of Guangdong Province on Gas Cylinder Safety and other relevant laws and regulations, on the basis of the actual conditions of this Municipality and with a view to preventing and reducing gas cylinder safety accidents and safeguarding life and property safety of the public.
Article 2 These Rules are applicable to the filling and inspection of gas cylinders, the transport, operation and use of bottled gas, related safety supervision and management and other relevant activities within the administrative areas of this Municipality.
The relevant national regulations and safety codes shall apply to design and manufacturing of gas cylinders.
The scope of gas cylinders referred to herein shall be subject to the special equipment catalogue approved by the State Council, including fuel gas cylinders, industrial gas cylinders, vehicle gas cylinders and gas cylinders for respirators. These Rules are not applicable to gas cylinders used for fire extinguisher, high volume gas cylinders for long-tube trailers and tube-bundle containers, non-refillable gas cylinders, and gas cylinders used for military equipment, nuclear facilities, aircraft and spacecraft, railway trains, marine facilities and ships, underground mines or special equipment in civil airports.
Article 3 The municipal administration for market regulation shall be responsible for supervising and managing the gas cylinder safety within the administrative areas of this Municipality, and organizing the implementation of these Rules.
The district administration for market regulation shall be responsible for supervising and inspecting the entities engaged in gas cylinder manufacturing, operation and filling as well as inspection and testing institutions within its respective administrative areas.
The authority in charge of urban management and comprehensive law enforcement shall be responsible for the supervision and management of bottled gas used for urban gas cylinders and vehicle gas cylinders.
The authorities in charge of public security, transportation, emergency management and the like as well as fire & rescue agencies shall be responsible for the tasks related to gas cylinder safety within the scope of their respective functions and duties.
Article 4 The municipal administration for market regulation shall organize the establishment of a technical committee on gas cylinder safety consisting of experts in this industry to analyze the safety management situations, safety hazards, and accident causes of gas cylinders in this Municipality, and propose corrective or preventive measures and suggestions on improvement of existing safety specifications and standards.
The authorities bearing responsibilities for gas cylinder safety supervision and management may improve the supervision and management system and implement targeted supervision and management measures based on the suggestions of the technical committee on gas cylinder safety.
Article 5 Trade associations of special equipment, gas and other relevant trades shall take more self-discipline measures, develop and implement industrial standards and specifications, and provide such services as gas cylinder safety management trainings, safety evaluation and assessment, etc.
Trade associations of special equipment are encouraged to establish and implement quality and credit ranking system for gas cylinder filling entities and inspection institutions, regularly announce the quality and credit ranking results to the public, and promote the construction of industrial credit system.
Article 6 The relevant sectors of the municipal and district people’s governments shall strengthen the promotion of and education on gas cylinder and bottled gas safety, popularize safety knowledge of gas use for production and daily life, and enhance the public’s awareness of gas safety.
Article 7 The municipal administration for market regulation shall collect the whole-process data information on gas cylinder manufacturing, filling, inspection, scrapping, etc. in this Municipality through the Guangzhou Gas Cylinder Quality and Safety Traceability Information System, so as to improve supervision and management efficiency.
Article 8 This Municipality encourages gas cylinder filling entities to implement scientific management methods, adopt new materials and advanced technologies, and improve the safety performance and risk management level of gas cylinders.
Article 9 This Municipality encourages entities engaged in gas cylinder filling, inspection, transportation, storage, operation and utilization to purchase corresponding liability insurances for gas cylinder safety.
Article 10 A gas cylinder filling entity shall fill only the gas cylinders that have been registered by it or its chain entities, except for vehicle gas cylinders and gas cylinders for respirators.
Gas cylinder filling entities shall set to-be-inspected cylinder areas, nonconforming cylinder areas, to-be-filled cylinder areas and conforming filled cylinder areas according to relevant safety specifications, and take effective separation measures.
A gas cylinder filling entity shall not store in to-be-filled cylinder areas and conforming filled cylinder areas any gas cylinder that is not registered under its own name or its chain entities, has not been inspected beyond the deadline, has failed the inspection, has been scrapped, or does not meet the safety specifications.
Article 11 Gas cylinder filling entities shall comply with the following provisions:
(1)Appoint inspectors for inspection of gas cylinders before and after filling and making notes. During gas cylinder filling operations, the operator is not allowed to concurrently serve as the inspector;
(2)Attach onto conforming filled gas cylinders warning labels and conformity labels or use other technical means to indicate that the filled gas cylinders have met safety specifications and standards, and cap the gas cylinders according to the corresponding gas cylinder standards;
(3)Apply onto the gas cylinders registered by their own the entity's name (brand name or trade name) or registered trademark of the filling entity, the date of the next inspection, and the telephone number for emergency rescue;
(4)Strengthen daily maintenance and self-inspection of gas cylinders to ensure that the color marks, safety accessories, and other aspects of the filled gas cylinders meet the requirements of related safety specifications and standards.
Article 12 In the case of filling of gas cylinders containing single gas, the filling entities shall fill the same gas as indicated in the design documents and manufacture marks, and shall not fill other gas except for the replacement gas used in the filling process.
In the case of filling of gas cylinders containing several kinds of gas, the filling entities shall fill the mixed gas with the same characteristics as indicated on the gas cylinder marks.
Article 13 The gas cylinder filling entity shall create a gas cylinder information registration file to register the gas cylinders filled by itself, record and manage the types, manufacturing information, inspection information, and unique identification numbers of the gas cylinders, and upload the gas cylinder registration information, results of inspection before and after filling, relevant information on cylinder filling, and other related information to the Guangzhou Gas Cylinder Quality and Safety Traceability Information System.
The entity engaging in filling of flammable and toxic media into gas cylinders shall implement automatic collection, storage, and uploading of filling information. Hydrogen cylinder filling entity shall also implement dynamic management of the whole process of information registration files, filling, sales and inspection of hydrogen cylinders.
The filling device used by the vehicle gas cylinder filling entity shall have the function of reading the vehicle license plate and electronic reading of the marks on the gas cylinders.
The gas cylinder inspection institutions shall manage the information on the inspected gas cylinders and upload the inspection data to the Guangzhou Gas Cylinder Quality and Safety Traceability Information System within 5 working days after the completion of the inspection.
Article 14 Gas cylinder filling entities shall develop scientific and reasonable accident prevention measures, contingency plans, and rescue measures in accordance with relevant standards, conduct drills at least once every six months, make corresponding records, and analyze and evaluate the pertinence and practicality of the plans. During the validity period of the gas cylinder filling permit, the gas cylinder filling entity shall complete all scheduled drills of the contingency plans and rescue measures for special equipment accidents developed by itself.
Gas cylinder filling entities shall install fire, electricity, and gas monitoring equipment, automatic fire warning equipment, and automatic fire extinguishing equipment in accordance with the national and provincial fire safety specifications, and ensure their connection to the fire remote monitoring system.
Article 15 The gas cylinder filling entity shall strengthen the maintenance of special equipment at the station and update it in a timely manner. For pressure vessels and pipelines that have reached its designed service life or that have been in service for over 20 years, if the gas cylinder filling entity believes that they can be further used normally, it shall entrust a special equipment inspection institution with corresponding qualifications to conduct a safety assessment.
Where continued use is acceptable as confirmed by the inspection institution, the gas cylinder filling entity shall apply for a change in the usage registration certificate, and take measures to strengthen inspection, testing and maintenance to ensure their safe use.
Article 16 Gas cylinder inspection institutions shall comply with the following provisions:
(1)Apply marks that indicate the next inspection date, the expiration date or termination date of use, on a conspicuous position of the gas cylinders that have passed the inspection;
(2)If serious accident hazards or tendency issues affecting the safety of gas cylinders are found during inspection, they shall be immediately reported to the administration for market regulation;
(3)Within 10 working days from the date of issuance of the inspection report, gas cylinders that fail inspection or scrapped cylinders shall be subject to destructive treatment in accordance with the law, and the whereabouts of the treated gas cylinders shall be recorded.
Article 17 Gas cylinder filling entities, inspection institutions or individuals shall not commit any of the following acts:
(1)Falsifying or changing gas cylinder manufacturing information, name of filling entity (brand name or trade name), or registered trademark;
(2)Welding, patching or renovating gas cylinders, or refurbishing scrapped gas cylinders;
(3)Sending scrapped cylinders that have not been deactivated to other entities or individuals;
(4)Filling gas into LPG cylinders without municipal uniform electronic labels;
(5)Improperly filling LPG cylinders by such means as mounting filling guns on supply and distribution pipelines and dismounting electromagnetic valves of filling balance.
Article 18 Bottled gas dealers shall not sell the following bottled gas:
(1)Bottled gas filled with flammable, combustible, toxic, and corrosive media by entities without gas cylinder filling licenses;
(2)Bottled gas without marks of filling entities, warning labels or conformity labels;
(3)Gas filled in cylinders not timely inspected, cylinders identified as nonconforming after inspection, scrapped cylinders, or LPG cylinders without municipal uniform electronic information labels; or
(4)Gas filled in unregistered cylinders.
Article 19 Entities and individuals using bottled gas shall not commit any of the following acts:
(1)Using gas contained in gas cylinders that have no prescribed information indicated, have exceeded the validity period of inspection, have failed the inspection, or have been scrapped;
(2)Using gas in LPG cylinders without municipal uniform electronic information labels;
(3)Testing for air leakage using an open flame;
(4)Storing and using gas in places lacking the conditions for safety use of gas;
(5)Inverting the gas in the cylinder into other cylinders, filling the already filled cylinder with other substances, or heating the already infilled cylinder;
(6)Disposing of residual liquid in gas cylinders by themselves;
(7)Changing the trademarks or other marks on the gas cylinders;
(8)Dismantling gas cylinders without authorization;
(9)Other acts prohibited by laws and regulations.
Article 20 Where an entity using commercial vehicle gas cylinders intends to register such cylinders at the municipal administration for market regulation, it shall submit vehicle operation qualification certificates and motor vehicle register certificates.
Where a vehicle gas cylinder needs to be replaced, the vehicle manufacturing entity shall be responsible for the replacement. After passing the supervision and inspection, the entity using vehicle gas cylinders shall register the vehicle gas cylinders with the municipal administration for market regulation, and handle the deregistration procedures for the used cylinders by presenting the certificate of deactivation issued by the inspection institutions.
No entity or individual may install or use vehicle gas cylinders on any vehicle that is not designed as gas-fueled vehicles.
Article 21 The entity using vehicle gas cylinders shall establish a safety management system for vehicle gas cylinders, set up a department for safety management of vehicle gas cylinders, or be staffed with full-time personnel for special equipment safety management, strengthen the maintenance of vehicle gas cylinders, and carry out emergency drills on a regular basis.
Article 22 The municipal administration for market regulation shall formulate and publicize safety specifications for filling of vehicle gas cylinders registered outside this Municipality on the basis of the actual conditions of this Municipality.
When filling vehicle gas cylinders registered outside this Municipality, the filling entities shall check the registration certificates of such cylinders and the vehicle licenses.
Article 23 In the case of retirement of gas-fueled vehicles, the gas cylinders used for the vehicles shall be scrapped together with the vehicles.
The entity using the vehicle gas cylinder shall handle deregistration procedures for the scrapped gas cylinders at the municipal administration for market regulation upon the certifications of deactivation issued by inspection institutions.
The municipal administration for market regulation shall send a copy of the information on vehicles that have been registered for the use of vehicle gas cylinders to the public security organs for their verification of the vehicle status. The public security organs shall then verify the vehicle status and assist in supervising the whereabouts of vehicle gas cylinders.
Article 24 The municipal administration for market regulation shall establish an accumulative scoring system. For gas cylinder filling entities and inspection institutions that violate relevant laws and regulations on special equipment safety and special equipment safety specifications, scores recording based on severity of the violation and classified management shall be implemented in addition to administrative penalties in accordance with the law.
Article 25 For any act that violates the provisions of these Rules, if there are existing punishment provisions in such laws and regulations as Special Equipment Safety Law of the People’s Republic of China, Regulations of Guangdong Province on Special Equipment Safety and Regulations of Guangdong Province on Gas Cylinder Safety, these provisions shall prevail.
Article 26 Where an authority and its staff, in violation of these Rules, fails to perform its/his/her duties, the competent authority shall order it/him/her to make corrections and impose punishment on the person in charge responsible and other persons directly responsible; if a crime is constituted, criminal liabilities shall be investigated and affixed according to law.
Article 27 These Rules shall come into force on April 1, 2024.
