　　Chapter I General Provisions

　　Article 1 In order to strengthen the protection and management of Beijing Road Pedestrian Street, promote people-oriented urban construction, protect and inherit urban history and culture, and promote the integration and development of culture, commerce and tourism, these Rules are developed in accordance with relevant laws and regulations and on the basis of the actual conditions of this Municipality.

　　Article 2 These Rules shall apply to the planning, protection, construction, utilization, management and service of Beijing Road Pedestrian Street.

　　Article 3 The area of Beijing Road Pedestrian Street herein includes: The northern section of Beijing Road (from Zhongshan Fifth Road Entrance to Guangwei Road Entrance), the middle section of Beijing Road (from Zhongshan Fifth Road Entrance to Wenming Road Entrance), Xihu Road (from Jiaoyu Road Entrance to Beijing Road Entrance), Huifu East Road (from Jiaoyu Road Entrance to Beijing Road Entrance), Yushan Road, Libai Lane, Shengxianli, Shuyuan Street and the section of Shufang Street subject to pedestrianization management.

　　If the area of Beijing Road Pedestrian Street is adjusted, the preparation of the adjustment scheme shall be organized by the People's Government of Yuexiu District, and shall be promulgated and implemented after being approved by the municipal people's government.

　　Article 4 The People's Government of Yuexiu District shall be responsible for the overall coordination, supervision and management of Beijing Road Pedestrian Street, ensure capital investment and organize the implementation of these Rules.

　　Guangzhou Beijing Road Cultural Core Area Management Committee (hereinafter referred to as the Management Committee) is responsible for drafting and implementing the overall development plan of Beijing Road Cultural Core Area, the plan for the format development of pedestrian street and related special plans, but the plan involving the protection of historical and cultural cities shall be implemented in accordance with relevant laws, regulations and provisions; coordinating and promoting the daily management and service work such as cultural protection, industrial development, investment attraction, enterprise service, publicity and promotion in Beijing Road Pedestrian Street.

　　The authorities in charge of development and reform, public security, finance, planning and natural resources, ecological environment, housing and urban-rural development, transportation, commerce, culture, radio, television and tourism, market regulation, urban management and comprehensive law enforcement, forestry and landscaping, etc. shall, in accordance with these Rules, perform their duties in the management and service of Beijing Road Pedestrian Street ex officio.

　　The relevant sub-district offices shall, in accordance with these Rules, cooperate with the Management Committee in the management and service of Beijing Road Pedestrian Street ex officio.

　　Article 5 The planning, protection, construction, utilization, management and service of Beijing Road Pedestrian Street shall follow the principles of government-led, social participation, scientific layout, market operation, protection priority, rational utilization and management according to law, so as to create a well-known pedestrian street with prosperous commerce, strong culture and standardized management.

　　Article 6 The Management Committee shall coordinate and carry out joint inspection actions such as safe production, fire control, transportation and market management according to needs, and relevant administrative departments and sub-district offices shall assist and cooperate.

　　The Management Committee shall establish and improve the information sharing mechanism with relevant administrative departments and sub-district offices, and inform each other of the management information of Beijing Road Pedestrian Street.

　　Article 7 The Management Committee shall establish a publicity and promotion platform for Beijing Road Pedestrian Street, and carry out publicity and promotion work for Beijing Road Pedestrian Street through radio, television, newspapers, communications, internet and other media, so as to expand the influence of the brand image of Beijing Road Pedestrian Street.

　　Chapter II Protection of History and Culture

　　Article 8 Historical sites (ruins), immovable cultural relics, historical streets, historical buildings, historic feature buildings, millennial ancient roads, excellent buildings of reform and opening-up, historical place names, historical anecdotes, arcade culture, Canton Temple Fair, West Lake Flower Fair, Lingnan cuisine and ancient and famous trees in Beijing Road Pedestrian Street are all protected historical and cultural resources.

　　The Management Committee shall investigate, confirm and register the historical and cultural resources in Beijing Road Pedestrian Street, establish files and related databases and disclose them to the public to form a dynamic update and maintenance mechanism for historical and cultural resources.

　　The use of such new technologies as three-dimensional surveying and mapping technology, digital technology and information technology is encouraged, so as to digitally file important historical and cultural resources including cultural relics, historical buildings and traditional arcade buildings in Beijing Road Pedestrian Street, and realize digital storage, display and information sharing of historical and cultural resources.

　　Article 9 The historical and cultural heritage and characteristic features in Beijing Road Pedestrian Street shall be given priority in protection, shall be protected with original site, and shall be protected systematically and as a whole.

　　Construction, reconstruction and expansion in the core protection area and construction control area of the historical and cultural block of Beijing Road Pedestrian Street shall conform to the protection plan and be implemented in accordance with the provisions on the protection of historical and cultural cities.

　　The Management Committee shall, in conjunction with the relevant sub-district offices and authorities, establish a joint prevention and control mechanism, strengthen the daily supervision and inspection of the protection of historical and cultural blocks, and dispose of any sabotage in a timely manner according to law.

　　Article 10 The person responsible for the protection of historical buildings in Beijing Road Pedestrian Street shall perform the protection responsibility for historical buildings in accordance with the regulations on the protection of famous historical and cultural cities. If a historical building is transferred or leased, both parties shall stipulate the obligation of protection and repair in the contract, and the transferor and lessor shall inform the transferee and lessee of the protection and repair requirements.

　　Article 11 Management Committee shall, in conjunction with the authorities in charge of commerce and culture, give support to the operators of time-honored brands in Beijing Road Pedestrian Street in accordance with relevant regulations, and support them to apply for inclusion into the List of Time-honored Brands and the List of Representative Works of Intangible Cultural Heritage.

　　Inheritors of representative works of intangible cultural heritage are encouraged and supported to carry out inheritance activities in Beijing Road Pedestrian Street. And the Management Committee shall coordinate and provide places and conditions for such inheritors to carry out inheritance and display activities.

　　Article 12 The operators in Beijing Road Pedestrian Street are encouraged and supported to spread and promote such cultural resources as time-honored brands and intangible cultural heritage through new media, expand creation, production and dissemination on the Internet, digitize offline cultural resources, innovate expression forms and deepen cultural connotations.

　　The operators in Beijing Road Pedestrian Street are encouraged and supported to transform and develop cultural resources such as time-honored brands and intangible cultural heritage, develop cultural products with Guangzhou characteristics, and realize the creative transformation and innovative development of excellent traditional cultural resources.

　　Article 13 When drafting and implementing the overall development plan of Beijing Road Cultural Core Area, the plan for the format development of pedestrian street and related special plans as well as carrying out construction projects and commercial business activities in Beijing Road Pedestrian Street, measures shall be taken to keep off ancient and famous trees and trees identified as follow-up resources of ancient trees. It is forbidden to cut down and relocate ancient and famous trees and trees identified as follow-up resources of ancient trees.

　　The Management Committee shall assist the administrative department of greening in establishing graphic files and electronic information databases of ancient and famous trees, dynamically manage the resources of ancient and famous trees, set up protection signs at the edge of the trunk of ancient and famous trees, and set up protection facilities such as guardrails when necessary.

　　The Management Committee shall strengthen the daily inspection of ancient and famous trees and follow-up resources of ancient trees in Beijing Road Pedestrian Street. If diseases and insect pests and abnormal growth of trees are found, it shall immediately report to the administrative department of greening, and the municipal and district administrative departments of greening shall organize professional protection and management organizations to rescue and rejuvenate.

　　Chapter III Business Promotion

　　Article 14 The Management Committee shall, according to the planning of Beijing Road Pedestrian Street and the principles of upgrading traditional formats, laying out new formats, developing local characteristic brands and time-honored brands, and introducing internationally renowned brands, prepare the business development plan and guidance catalogue of Beijing Road Pedestrian Street, develop support policies to encourage the development of key formats, solicit public opinions, and report to the People's Government of Yuexiu District for approval before promulgation and implementation in accordance with the prescribed procedures.

　　Article 15 The Management Committee shall guide the business projects in the region to coordinate with the business development plan and guidance catalogue of Beijing Road Pedestrian Street; policy support may be given to business projects that are conducive to highlighting the cultural characteristics of Beijing Road Pedestrian Street.

　　The Management Committee shall, in conjunction with the authorities in charge of commerce, market regulation, etc., take measures in daily investment promotion, business regulation, commercial management and settlement services for enterprises and merchants in Beijing Road Pedestrian Street ex officio, guide enterprises and merchants to operate according to the business development plan and guidance catalogue of Beijing Road Pedestrian Street, continuously optimize the business environment in Beijing Road Pedestrian Street, and improve the business quality and operating service level.

　　Article 16 The People's Government of Yuexiu District shall focus on promoting the construction of such digital application scenarios as digital finance, digital commerce and smart culture and tourism in Beijing Road Pedestrian Street, innovating service contents and modes, and improving service quality and efficiency.

　　The People's Government of Yuexiu District, jointly with the authorities in charge of commerce, etc., shall promote the development of digital commerce in Beijing Road Pedestrian Street, and guide the development of gathering areas, platforms and promotion systems that support service trade and digital trade, cultivate and promote new formats and models such as cloud services, digital content, digital services and cross-border electronic commerce, support the construction of digital commerce platform, develop social e-commerce and live broadcast e-commerce, improve the development mechanism and supervision mode, build a high-level service trade and digital trade open system in line with international standards, and enhance the digital commerce level in Beijing Road Pedestrian Street.

　　Article 17 The Management Committee shall carry out the preparation of activity planning, formulate the contents of recent and annual activity planning, actively introduce creative activities such as fashion, animation, art, science and technology, give full play to the role of the market, and stimulate the initiative and enthusiasm of social participation.

　　The Management Committee shall unite with the industry chambers of commerce, industry associations and enterprises in Beijing Road Pedestrian Street to create a characteristic commercial gathering area in combination with the actual situation in Beijing Road Pedestrian Street, encourage enterprises in Beijing Road Pedestrian Street to hold various consumption promotion activities, carry out online and offline preferential promotions during the activities, enhance the commercial atmosphere in Beijing Road Pedestrian Street, and promote the construction of an international consumption center city.

　　Article 18 For activities within the daily business scope, such as theatrical performances, exhibitions, trade fairs, exchange meetings, lottery sales for on-site lottery, charity, which are held within the area of Beijing Road Pedestrian Street, the Management Committee shall, in accordance with the regulations on safety management of large-scale mass activities, work out safety and security work plans in conjunction with relevant departments, and organize their implementation.

　　Article 19 The Management Committee shall strengthen the publicity of credit culture in Beijing Road Pedestrian Street, develop the credit management platform of Beijing Road Integrity Business District, establish credit files for operators, and guide operators to carry out credit repair work; establish a business district integrity mechanism where multiple parties participate in credit evaluation, consumers are supported to protect their rights, and trustworthy operators are given encouragement, and build a credit demonstration block.

　　Article 20 The People's Government of Yuexiu District shall, in conjunction with the municipal authority in charge of culture, radio, television and tourism, support the construction of smart tourist attractions in Beijing Road Pedestrian Street, encourage the development of quality tourist routes in Beijing Road Pedestrian Street, cultivate well-known tourism brands, provide intelligent tourism services, cultivate new modes of network experience and consumption such as cloud tourism, and promote the integration of commerce, culture and tourism in Beijing Road Pedestrian Street.

　　The Management Committee shall strengthen the publicity of civilized tourism in Beijing Road Pedestrian Street, guide tourists to travel in a safe, civilized and environmentally-friendly way, and encourage tourism operators to develop and operate low-carbon, green and environmentally-friendly tourism products with Guangzhou characteristics.

　　Article 21 The Management Committee shall plan and coordinate the construction of smart blocks in Beijing Road Pedestrian Street, and use such new technologies as camera monitoring systems, 5G networks, big data, artificial intelligence and naked-eye 3D in block management, including passenger flow diversion and smart block creation.

　　The Management Committee shall scientifically set up tourist service centers or self-service tourist information multimedia facilities in Beijing Road Pedestrian Street to provide tourists with necessary information and consulting services such as block tourist routes, transportation, meteorology, shopping, accommodation, catering, parking, early warning of passenger flow, medical first aid.

　　Article 22 Industry chambers of commerce and industry associations in Beijing Road Pedestrian Street shall play the functional role of providing services, reflecting demands and standardizing behaviors. They may develop industry self-discipline norms, implement self-discipline management, improve the level of operating services, promote credible operation and safeguard the legal rights and interests of all parties by extensively collecting opinions from merchants.

　　Chapter IV Block Management

　　Article 23 The urban management and comprehensive law enforcement authority entrusts the Management Committee to exercise the following urban management powers in Beijing Road Pedestrian Street:

　　(1) Administrative penalties for spitting, urinating, littering peel, paper scraps and cigarette butts and other waste;scribbling or carving or hanging or posting propaganda materials without approval on urban buildings, facilities and trees; stacking and hanging articles that hinder the appearance of the city on the balconies and windows of buildings facing the street specified by the people's government of the city; failing to fulfill the obligation of cleaning in the sanitation responsibility area or failing to remove and dispose of garbage and feces as required; transporting liquid and bulk goods without sealing, bandaging and covering, resulting in leakage and spilling; not setting guardrails or shielding construction sitesfacing the street, not arranging and covering the shutdown sites in time, or not cleaning and leveling the sites in time after completion, which affects the city appearance and environmental sanitation.

　　(2) The supervision and inspection of city appearance and environmental sanitation in the area of responsibility.

　　(3) Administrative penalties for failing to dismantle and clean up temporary facilities and wastes generated in time after the end of construction or activities in both sides of roads and public places temporarily occupied upon approval due to construction or holding festive, cultural, sports or other activities.

　　(4) Administrative penalties for occupying roads, bridges, footbridges, underground passages and other public places to set up stalls, peddle goods or pile up and dry waste goods, which affects the city appearance and environmental sanitation.

　　(5) Administrative penalties for sweeping garbage into sewers or piling up garbage on sidewalks, roads, flower beds and green belts.

　　(6) Administrative penalties for dumping, throwing, stacking or burning domestic garbage at will.

　　(7) Administrative penalties for failing to carry out construction activities in the core protection area and construction control zone of historical and cultural blocks, historical buildings and historic scenic areas as required.

　　(8) Administrative penalties for setting outdoor advertising, signboards and other external facilities that do not comply with the protection plan.

　　(9) Administrative penalties for demolishing buildings, structures or other facilities other than historical buildings within the core protection area of historical and cultural blocks without the approval of the competent department of urban and rural planning in conjunction with the competent department of cultural relics at the same level.

　　(10) Administrative penalties for occupying traditional streets and roads in historical and cultural blocks; scratching and smearing historical buildings; building or occupying land illegally to build buildings and structures; demolishing and changing the courtyard wall without authorization, changing the internal or external structure, shape or style of the building, etc. without authorization, which have destructive effects on the protected objects.

　　(11) Administrative penalties for setting, moving, altering or damaging the protection signs of historical and cultural blocks without authorization.

　　If the People's Government of Yuexiu District and the government sectors thereof have handed over the management authority specified in the preceding paragraph to the relevant sub-district offices, the power shall be uniformly exercised by the Management Committee in the Beijing Road Pedestrian Street.

　　Article 24When engaging in commercial business activities in Beijing Road Pedestrian Street,it is not allowed to use high-pitched loudspeakers or use other high-noise methods to attract customers.

　　The public security organ entrusts the Management Committee to exercise the administrative penalty for making noise and interfering with the normal life of others in Beijing Road Pedestrian Street.

　　Article 25 The details of the entrusted matters mentioned in Articles 23 and 24 herein shall be clearly defined by the Management Committee, the urban management and comprehensive law enforcement authority and the public security organ in the entrustment agreement and announced to the public. The urban management and comprehensive law enforcement authority and the public security organ shall guide and supervise the Management Committee to exercise the abovementioned power.

　　Article 26 The city appearance and environmental sanitation responsibility area system shall be implemented in Beijing Road Pedestrian Street, the person in charge of the city appearance and environmental sanitation responsibility area shall do a good job in the city appearance and environmental sanitation work in the responsibility area according to law.

　　Organizations and individuals entering Beijing Road Pedestrian Street shall maintain city appearance and environmental sanitation and take good care of public service facilities.

　　Article 27 The Management Committee shall develop guidelines for signboards in Beijing Road Pedestrian Street according to the outdoor advertising and signboard setting standards prepared by the municipal urban management and comprehensive law enforcement authority, and implement daily inspections, guidance, supervision and management.

　　The Management Committee shall guide the operators to set signboards whose color tone, shape, size, lighting, text content & spelling and foreign language signs shall be coordinated with the building style, business orientation and the overall style of the surrounding area of Beijing Road Pedestrian Street, and meet the requirements of protection planning, setting specifications and the appearance standards of historical and cultural blocks.

　　The signboard setter shall strengthen the daily maintenance and management, and keep the signboard safe, intact, beautiful and tidy. If the signboard is worn out, aged or defaced, it shall be repaired, cleaned or dismantled in time.

　　Article 28 The decoration or ornamentation inside and outside shops in Beijing Road Pedestrian Street shall conform to the regulations on the protection of famous historical and cultural cities, the requirements of relevant protection plans and the overall planning for the renovation and upgrading of Beijing Road Pedestrian Street, and be coordinated with the historical and cultural features of Beijing Road Pedestrian Street. 

　　Article 29 The pedestrianization management shall be implemented in Beijing Road Pedestrian Street, and motor vehicles and non-motor vehicles shall be prohibited from entering, and relevant signs on prohibiting and restricting vehicles from entering the pedestrian street shall be set up, except for rickshaws for the disabled, hand-pushed children's carts and fire engines, police cars, ambulances and emergency vehicles performing official duties; sanitation and other operation vehicles that really need to enter shall obey the management of the Management Committee, drive according to the designated time and route, and park at the designated position.

　　The People's Government of Yuexiu District shall, in conjunction with the municipal authorities in charge of public security, transportation, etc., develop and adjust the pedestrianization scheme of Beijing Road Pedestrian Street and the traffic organization scheme of the surrounding areas of Pedestrian Street, solicit public opinions, and report to the municipal people's government for approval before promulgation and implementation.

　　The Management Committee shall assist the public security organs to carry out the management of guiding, restricting and prohibiting the passage of motor vehicles, non-motor vehicles and pedestrians entering Beijing Road Pedestrian Street.

　　Article 30 The transportation authority of Yuexiu District shall, in conjunction with the Management Committee, strengthen the construction and overall management of public parking lots in Beijing Road Pedestrian Street and its surrounding areas, improve the level of information management, and set up parking lot guidance signs in prominent positions.

　　Organizations or individuals in and around Beijing Road Pedestrian Street are encouraged to set up temporary parking lots by using lands to be built and existing construction lands.

　　Organs, enterprises and public institutions in and around Beijing Road Pedestrian Street are encouraged to open their own parking lots to the public and implement shared parking at the staggered time if possible.

　　Shopping malls and civil parking lots in and around Beijing Road Pedestrian Street are encouraged to open to the public, provide parking convenience, and enhance tourism and commercial benefits.

　　Article 31 Tree protection measures shall be taken in the project construction and commercial business activities in Beijing Road Pedestrian Street. If trees need to be cut down, relocated or pruned due to special reasons, they shall be implemented in accordance with the provisions of greening management.

　　The Management Committee shall assist the administrative authority in charge of greening in setting tree signs in the Beijing Road Pedestrian Street, gradually establish tree files, and strengthen the daily inspection of trees in the Beijing Road Pedestrian Street.

　　Article 32 State organs, enterprises and public institutions, people's organizations, social organizations, grassroots mass self-governing organizations, etc. are encouraged and supported to organize voluntary service activities in Beijing Road Pedestrian Street, and provide places and other convenient conditions for voluntary service; volunteers with professional knowledge and skills are encouraged and supported to provide voluntary service.

　　Article 33 The Management Committee shall allocate necessary first-aid medicines and equipment in the Beijing Road Pedestrian Street. In the daily management and service of pedestrian street, staff or volunteer who have received first aid training shall be arranged on duty, relevant personnel shall be regularly organized to receive primary health rescue training, and assist in emergency on-site rescue in pre-hospital medical first aid and emergencies.

　　Article 34 The Management Committee shall, together with relevant sub-district offices and authorities, establish a joint mechanism for handling emergencies in Beijing Road Pedestrian Street,  develop the corresponding emergency plans according to the relevant laws, regulations and rules, the emergency plans of the people's government at a higher level and the relevant government sectors thereof and on the basis of the actual conditions of Beijing Road Pedestrian Street, organize drills, and revise the emergency plans timely according to the actual needs and in case of changes in the situation.

　　Article 35 The Management Committee shall open and improve the channels for complaints, opinions and suggestions, set up a tourist service and complaint acceptance center in a prominent position in Beijing Road Pedestrian Street, publicize tourism consultation, complaints and help hotlines, set up graphic symbols of public information, timely mediate disputes between operators and consumers, protect the legal rights and interests of consumers, and maintain a good business order.

　　When the Management Committee handles the matters mentioned in the preceding paragraph, the relevant organizations and departments shall cooperate.

　　Chapter V Legal Liability

　　Article 36 Violation of the provisions of these Rules and matters entrusted to the Management Committee as stipulated in Articles 23 and 24 shall be punished by the Management Committee in accordance with the provisions of relevant laws, regulations and rules. If laws, regulations and rules on other matters have already stipulated that the relevant administrative departments shall impose punishment, such provisions shall prevail.

　　Article 37 If the relevant municipal/district government sectors and their staff and the Management Committees and their staff, in violation of the provisions of these Rules, fail to perform their statutory duties or neglect their duties, abuse their powers or engage in malpractices for personal gain, the competent authorities shall order them to make corrections, give informed criticism to the department, and deal with the directly responsible persons in charge and other directly responsible persons according to law; if a crime is constituted, criminal responsibility shall be investigated according to law.

　　Chapter VI Supplementary Provisions

　　Article 38 [Date of enforcement]

　　These Rules shall come into force on May 1, 2022.
