Measures of Guangzhou Municipality for Giving Preferential Treatment to the Elderly

  (Issued on June 13, 2001 in accordance with Decree No. 8 of the People's Government of Guangzhou Municipality, amended for the first time on September 30, 2015 in accordance with Decree No.132 of the People's Government of Guangzhou Municipality and amended for the second time on January 29, 2021 in accordance with Decree No.179 of the People's Government of Guangzhou Municipality)

  Article 1     These Measures are formulated in accordance with the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly, the Regulations of Guangdong Province on the Protection of the Rights and Interests of the Elderly and relevant provisions, on the basis of the actual conditions of Guangzhou, and with a view to protecting the legitimate rights and interests of the elderly, developing elderly care, actively responding to the aging population, and carrying forward the Chinese nation’s virtues of respecting, supporting and helping the elderly.

  Article 2     The citizens aged 60 or above who have registered permanent residence in Guangzhou or hold valid residence documents in Guangzhou shall enjoy preferential treatment provided by these Measures.

  State organs, social organizations, enterprises, public institutions, grassroots mass autonomous organizations and other organizations shall perform the duties and obligations to give preferential treatment to the elderly in accordance with the provisions of these Measures.

  Article 3     The municipal health commission shall be responsible for organizing the implementation of these Measures. All relevant authorities shall coordinate with the implementation of these Measures ex officio.

  The municipal working commission on elderly care is responsible for organizing, coordinating, guiding and urging the relevant authorities to give preferential treatment to the elderly in its administrative area, approving, producing, issuing and administering preferential treatment certificates for the elderly in Guangzhou, and gradually implementing electronic preferential treatment certificates.

  The district working commissions on elderly care are responsible for organizing, coordinating, guiding and urging the relevant authorities to give preferential treatment to the elderly, accepting and preliminarily examining the applications for the preferential treatment certificates for the elderly in Guangzhou, and administering such preferential treatment certificates.

  Article 4     The people's governments at all levels in Guangzhou and their relevant government sectors shall, based on the actual social economic conditions, give preferential treatment to the elderly in such aspects as government services, health care, sports, leisure, traffic, mobility, public commercial services and rights protection services, so as to gradually improve the preferential treatment level.

  Article 5     The people's governments at all levels in Guangzhou and their relevant government sectors and service providers shall use information and intelligent means to provide accurate and high-quality services for the elderly; when improving the level of IT and intelligent service, they shall respect the behavior habits of the elderly and reserve the traditional service modes familiar to the elderly.

  Relatives, friends, villagers' committees, residents' committees, elderly associations and volunteers are encouraged to provide appropriate help for the elderly to use intelligent products.

  Service providers, educational institutions, pension service institutions and social organizations are encouraged to enhance the level of information and intelligent application for the elderly by holding lectures and training.

  Article 6     The elderly aged 60-65 can enjoy a half-price discount when taking buses, trolly buses, river crossing ferries, aquabuses or urban rail transit with preferential treatment certificates for the elderly in Guangzhou.

  The elderly over 65 years old can enjoy the preferential treatment mentioned in the preceding paragraph free of charge with the preferential treatment certificates for the elderly in Guangzhou.

  Article 7     Urban public transport, highway, railway, waterway, air passenger and other transport service providers shall give the elderly the priority in purchasing tickets, entering and leaving stations, having tickets checked, getting on and off trains, ships, planes and obtaining other services. Special seats for the elderly shall be set up in waiting rooms at railway stations, ports and airports.

  Article 8     Health care institutions shall reserve a certain proportion of appointments for elderly patients, keep manual service windows for registration, payment and printing of test reports, and provide medical guidance services for elderly patients by being equipped with guiding nurses, volunteers, social workers and other personnel.

  Public hospitals shall reduce the general outpatient consultation fee for the elderly who hold the preferential treatment certificates for the elderly in Guangzhou. The specific reduction standards shall be separately formulated by the municipal health commission.

  Qualified health care institutions shall provide family sickbed services for the elderly.

  Article 9     Government service, health care institutions, postal, telecommunication, banking, power supply, water supply, gas supply, communication, cable TV and other service providers shall set up special service windows or priority signs for the elderly, and shall actively provide guiding and consultation services for the elderly, and give priority to performing relevant services for them.

  Article 10   Shopping malls, catering, tourism, culture and other service providers are encouraged to provide various priorities and preferential and high-quality services for the elderly according to their own service characteristics, and set up obvious preferential treatment marks and signs in their respective business places.

  Article 11   The sub-district office sand the town people's governments shall provide community smart elderly care and community support services for the elderly, create convenient service files for the convenience of the elderly, and provide timely services for the elderly.

  Article 12   If any elderly person qualified for legal aid in Guangzhou apply for legal aid, the legal aid institution shall provide legal aid for him/her promptly according to law.

  If any elderly person qualified for legal aid under the Measures of Guangzhou Municipality for the Implementation of Legal Aid holds his/her preferential treatment certificate for the elderly in Guangzhou to apply for notarization, the relevant notary office shall exempt him/her from the notarization fee or reduce the notarization fee in accordance with the regulations.

  The specific standards for reduction or exemption shall be separately formulated by the municipal justice bureau.

  Article 13   The preferential treatment certificates for the elderly in Guangzhou applied for and reissued from the effective date of these Measures shall be valid for two years. The specific measures for the administration of the preferential treatment certificates for the elderly in Guangzhou shall be formulated separately by the municipal health commission.

  Any elderly person who is qualified under these Measures can apply to the competent district working commission on elderly for a preferential treatment certificate for the elderly in Guangzhou, through the sub-district or town government service center in the place where his/her registered permanent residence is located or where he/she lives or through the online service platform. After the preliminary verification by the district working commission on elderly, the application shall be submitted to the municipal working commission on elderly for unified approval, production and issuance.

  Within one month before the expiration of the term of validity of his/her preferential treatment certificate for the elderly in Guangzhou, the elderly person can apply for renewal through the sub-district or town government service center in the place where his/her registered permanent residence is located or where he/she lives, or through the self-service renewal terminal or online service platform.

  When an individual applies for issuance, renewal, re-issuance or upgrading a preferential treatment certificate for the elderly in Guangzhou, he/she shall provide valid documents and sign a letter of commitment to authenticity of information.

  The expenses incurred for inability to enjoy preferential treatment due to failure to timely renew, reissue or upgrade the preferential treatment certificate for the elderly in time shall be borne by the elderly person himself/herself.

  Article 14   An elderly person's preferential treatment certificate for the elderly may only be used by the elderly person. No organization or individual may buy, sell, forge or alter preferential treatment certificates for the elderly.

  It is forbidden to use any forged, altered or expired preferential treatment certificates for the elderly or to falsely use other people's preferential treatment certificates for the elderly.

  Article 15   If an organization obliged to provide preferential service for the elderly fails to perform its obligation of preferential service in accordance with these Measures, the competent authority shall punish the organization in accordance with the relevant provisions of the Regulations of Guangdong Province on the Protection of the Rights and Interests of the Elderly.

  Article 16   If an individual violates the provisions of the fourth paragraph of Article 13 and the second paragraph of Article 14 of these Measures, by providing false information to apply for a preferential treatment certificate for the elderly in Guangzhou, or falsely uses another person's preferential treatment certificate for the elderly in Guangzhou, the competent working commission on aging shall stop the preferential treatment function of the preferential treatment certificate for the elderly.

  If a service provider discovers that another person falsely uses a preferential treatment certificate for the elderly in Guangzhou, it shall submit the relevant information to the competent working commission on elderly care.

  Article 17   Whoever, in violation of the provisions of the first paragraph of Article 14 of these Measures, buys, sells, forges or alters any preferential treatment certificates for the elderly shall be punished by the competent public security organ in accordance with the relevant provisions of the Law of the People's Republic of China on Administrative Penalties for Public Security; if a crime is constituted, criminal responsibility shall be investigated according to law.

  Whoever violates the second paragraph of Article 14 of these Measures by using a forged or altered preferential treatment certificate for the elderly shall be punished by the competent public security organ in accordance with the relevant provisions of the Law of the people's Republic of China on Administrative Penalties for Public Security; If a crime is constituted, criminal responsibility shall be investigated according to law.

  Article 18   If any relevant administration and its staff violate the provisions of these Measures by failing to perform their duties in accordance with the law, they shall be ordered by the competent authority to make corrections, and the responsible leaders and the directly responsible personnel shall be punished in accordance with the law; if a crime is constituted, criminal responsibility shall be investigated according to law.

  Article 19   These Measures shall come into force on May 1, 2021.
