Rules of Guangzhou Municipality on Patriotic Health Work
Article 1 In order to better meet the people’s needs for a better life, promote the improvement of environmental sanitation, prevent and control diseases, improve the people’s health and quality of life, and promote the construction of a healthy Guangzhou, these Rules are developed in accordance with the Law of the People’s Republic of China on Basic Medical and Health Care and the Promotion of Health, the Regulations of Guangdong Province on Patriotic Health Work and other laws and regulations and on the basis of the actual conditions of this Municipality.
Article 2 These Rules shall apply to the patriotic health work within the administrative area of this Municipality.
Article 3 Patriotic health work implements the principles of people’s health as the center, the leadership of the Party, government-led launch, departmental coordination, participation of the whole people, social supervision and scientific governance.
Article 4 People’s governments at all levels shall strengthen their leadership over patriotic health work within their respective administrative areas, establish a long-term management mechanism for patriotic health, incorporate patriotic health work into the medium-term and long-term plans and annual plans for national economic and social development, improve public health infrastructure, promote environmental health governance, improve the overall level of environmental health, and make the improvement of the overall level of social health adapt to economic development and social progress.
Article 5 People’s governments at all levels shall guarantee the funds for patriotic health work, incorporate the funds for patriotic health work into the financial budget of the people’s government at the corresponding level, and focus on ensuring the funds for consolidating and developing national health cities, creating healthy villages and towns, developing healthy cities and healthy villages and towns, preventing and controlling vectors, controlling smoking, publicizing and training, etc.
Article 6 Under the leadership of the people’s government at the same level, the municipal and district patriotic health campaign committees (hereinafter referred to as PHCC) shall be responsible for organizing and coordinating patriotic health work in their respective administrative areas, developing patriotic health work plans within their respective administrative areas, and organizing and mobilizing the whole society to participate in patriotic health activities.
The municipal and district PHCC offices (hereinafter referred to as PHCCO) are the administrative bodiesof PHCC at the same level, which are responsible for the daily work of PHCC and the organization of memberagencies to carry out patriotic health work.
Town people’s governments and sub-district offices shall clearly define the organizations and their staff responsible for the daily work of patriotic health, and be responsible for the daily work of patriotic health.
Residents’ committees and villagers’ committees shall be responsible for organizing entities and individuals within their respective jurisdictions to participate in patriotic health activities.
Article 7 PHCC shall implement the member agencies accountability system. All member agencies shall, according to their respective functions and the division of responsibilities of PHCC, jointly participate in patriotic health work.
Article 8 State organs, troops, enterprises,public institutions, social organizations and other organizations shall, under the unified guidance of the local PHCC, organize and carry out their own patriotic health work.
Voluntary service organizations, volunteers and other social forces are encouraged and supported to participate in patriotic health work.
Families and individuals are encouraged to participate in patriotic health activities.
Article 9 April is the Guangzhou Patriotic Health Month, and April 22 is the Guangzhou Patriotic Health Day.
On the Patriotic Health Day, PHCC at any level shall carry out thematic patriotic health activities in a centralized manner.
Article 10The municipal PHCC shall organize Patriotic Health Month and Patriotic Health Day activities every year.
District PHCC shall carry out a unified action with the main content ofclearing sanitary dead corners and breeding grounds of vector organisms once a month.
Town people’s governments and sub-district offices shall organize communities and villages to carry out a public environmental health clean-up every week, and urge organs, public institutions and social organizations within their respective jurisdictions to carry out an internal environmental health clean-up.
Article 11The entities and individuals shall, in accordance with the requirements of the relevant administrative regulations on city appearance and environmental health, implement the city appearance and environmental health responsibility area system and fulfill the city appearance and environmental health responsibility in their responsibility area. PHCC at any level shall organize monthly inspection, assessment and supervision of the implementation of thecity appearance and environmental health responsibility area system.
Article 12 People’s governments at all levels shall establish a health promotion and health education work system led by the government, coordinated by authorities and participated by the society, strengthen the comprehensive coordination of health education, take various forms to carry out health education, advocate the concept of “health first” and “citizens are the first responsible person for their own health”, and cultivate and improve the health awareness and self-care ability of urban and rural residents.
Article 13The municipal and district people’s governments shall strengthen the management of the operation and maintenance of rural water supply projects and promote the extension of the municipal water supply network to households, thereby ensuring the safety and hygiene of rural drinking water.
Article 14 People’s governments at all levels shall organize the treatment of rural domestic sewage according to local conditions, and treat rural domestic sewage by incorporating it into urban sewage treatment systems, building sewage treatment facilities, resource utilization of sewage and natural ecologyconsumption and other ways, so as to improve the sewage treatment capacity.
Article 15 People’s governments at all levels shall develop special plans and annual work plans for toilet construction and management. PHCC at any level shall urge relevant organizations to implement special plans and annual work plans for toilet construction and management.
Town people’s governments and sub-district offices shall be responsible for organizing the implementation of rural toilet improvement work, and villagers’ committees and residents’ committees shall provide support.
Article 16Rural toilets shall be built or transformed in accordance with the prescribed standards and requirements for the harmless treatment of feces.
Article 17Urban environmental health remediation work shall be carried out in accordance with the relevant management regulations of city appearance and environmental health.
Rural environmental health remediation work shall meet the following requirements:
(1) No exposed domestic garbage and construction waste atthe roadside, riverside, bridge and other public environments;
(2) No floating garbage in rivers, ponds, ditches and other water bodies ;
(3) No arbitrary posting, scribble or hanging on walls, telephone poles, facades and trees;
(4) The poultry and livestock in the village shall be kept in captivity, so as to ensure thatthere are no free-range poultry or livestock;
(5) There is littering on neither side of the main road and neither in front of and behind the houses of farmers, and such building materials as bricks, tiles, stones and sand are stacked neatly;
(6) The main roads are hard-bottomed, and there are no mounds, manure piles or sewage pits;
(7)The sewer system is complete and smooth.
Article 18Town people’s governments shall, in accordance with the standards of national and provincial health towns, carry out activities to create national and provincial health towns.
Villagers’ committees and residents’ committees shall, in accordance with the standards of provincial health villages, carry out activities to create provincial health villages.
Article 19 Municipal and district disease prevention and control institutions shall organize the monitoring of vector population distribution, density and drug resistance, establish a vector monitoring network, regularly carry out risk assessment, risk report and control effect evaluation, and timely report the monitoring results to the local PHCC. The local PHCC shall timely take appropriate measures to notify the residents in the area.
Article 20The municipal/district PHCC shall establish a vector prevention and control system,develop the information management system, organize inspections of breeding grounds of vector organisms within the jurisdiction, guide and urge the organizations of town people’s government and sub-district offices that undertake daily work of patriotic health to carry out vector prevention and control work, and respond at different levels in accordance with the vector density classification and response work guidelines of this Municipality.
Town people’s governments and sub-district offices shall carry out vector prevention and control work within their respective jurisdictions, organize vector prevention and control actions at least once a month, inspect key breeding grounds of vector organisms within their respective jurisdictions, urge entities and individuals to remove all kinds of breeding grounds of vector organisms in a timely manner, and properly handle the killed vectors.
Article 21Industry associations in the field of vector prevention and control are encouraged to participate in the development of industry standards, develop service standards according to industry standards, provide professional training for service institutions and their employees engaged in vector prevention and control, and popularize and apply advanced vector prevention and control technologies, methods, drugs and devices.
Vector prevention and control service institutions are encouraged to create vector prevention and control operation procedures, operation ledgers and rosters of employees, and provide professional training for their employees in accordance with relevant standards and regulations. The municipal/district PHCCO shall supervise and manage the service contents, types of drugs used and work quality of paid service institutions for vector prevention and control within its jurisdictions.
Article 22Entities and individuals shall, in accordance with the vector prevention and control requirements, take preventive and control measures against such vectors as rats, mosquitoes, flies, cockroaches,fleas, etc, remove accumulated water and garbage in a timely manner and seal septic tanks and clean them regularly to eliminate vectors and their breeding conditions, thereby controlling the density of vectors in working and living places within the scope of the standard stipulated by the state.
Entities and individuals may entrust qualified vector prevention and control service institutions to carry out prevention and control.
Article 23 Theregional management responsible person system is adopted for vector prevention and control work. The owners, users, operators or managers of the following entities or premises shall set up vector prevention and control facilities and implement the accountability system as follows:
(1)The residential areasavailable with property management shall be the responsibility of property service enterprises;
(2) Organs, organizations, troops, schools, hospitals, factories and other entities shall be responsible for their own;
(3) The interiors ofshops with street frontage shall be the responsibility of operators;
(4) Bazaars, exhibition areas, shopping malls and other places shall be the responsibility of operators or managers;
(5) Cultural and entertainment places, sports venues, scenic spots, parks, public green spaces and other public places shall be the responsibility of operators or managers;
(7) Urban rail transit facilities, tunnels, elevated roads, highways and railways shall be the responsibility of operators or managers;
(8) Construction sites shall be the responsibility of the construction contractors, and the unused lands shall be the responsibility of the land use right holders;
(9) Food production and business premises and grain depots shall be the responsibility of operators or managers;
(10) Farms, salvage stations, refuse transfer stations, refuse disposal plants, public toilets and other places that are easy to incur or breed vectors shall be the responsibility of operators or managers;
(11) The owners or the usersshall be responsible for their residences.
The prevention and control of vectors in areas other than those specified in the preceding paragraph shall be the responsibility of the local sub-district offices and town people’s governments.
Article 24People’s governments at all levels shall strengthen their leadership over smoking control and incorporate smoking control into the national economic and social development plans within their respective administrative areas.
Smoking is prohibited in indoor public places, indoor public office places, public transport vehicles and other public places stipulated by laws, regulations and rules in urban areas. The municipal people’s government may, according to the actual needs of economic and social development, gradually add places to the smoking prohibition lists
People’s governments at all levels and their relevant sectors andagencies shallbe responsible for the publicity and education, daily management and supervision of smoking control in various places ex officio. Party and government organs, enterprises and public institutions shall actively create smoke-free office space.
Article 25 PHCC at any level shall promote the construction of healthy cities, healthy villages and towns and healthy communities, carry out activities to create healthy organizations, healthy schools, healthy hospitals, healthy families, etc., and promote social participation.
Article 26 PHCC at any level shall organize and carry out patriotic health campaigns in various forms, regularly inspect or randomly check the situations of patriotic health work carried out by member agencies and entities and individuals within its jurisdictions, and report the annual inspection results to the people’s government at the same level and announce them to the public.
Any entity or individual has the right to dial the government service hotline of 12345, or complain and report to the local PHCC and its member agencies for violations of patriotic health management.
PHCC at any level and its member agencies shall establish a reporting system according to patriotic health work duties, make the reporting telephone numbers, mailboxes or e-mail addresses public, and deal with reported matters in a timely way.
Article 27 The municipal PHCC shall circulate a notice of commendation for entities and individuals who have made outstanding contributions to patriotic health work.
Any Entity or individual who fails to carry out patriotic health work in accordance with these Rules shall be dealt with by the relevant authorities in accordance with relevant laws, regulations and rules.
Article 28If an entity or individual violates the provisions of Paragraph 1 ofArticle 22 herein by failing to take preventive and control measures against vectors, and the density of vector is found any disease prevention and control institution to exceed the national standards, it shall be handled by the public health authorityor the competent authority designated by the government in accordance with Article 69 of the Regulations of Guangdong Province on Patriotic Health Work.
Article 29 If the relevant authorities and their staff violate these Rules by failing to perform their duties according to law, the competent authorities shall order them to make corrections, and punishments shall be given to persons in charge directly and persons directly responsible, and whereas the case constitutes a crime, criminal responsibilities shall be affixed.
Article 30 These Rules shall come into force on April 1, 2022.
