Project Management Rules of Guangzhou Municipality on Civilized Construction

  (Issued on January 5, 2012 in accordance with Decree No. 62 of thePeople’s Government of Guangzhou Municipality and amended on February 13, 2018 in accordance with Decree No. 158 of the People’s Government of Guangzhou Municipality)

  Article 1 In order to strengthen the construction project management of civilized construction and maintain the cleanliness of the urban environment, these Rules are formulated in accordance with the relevant laws and regulations of the State and on the basis of the actual conditions of this Municipality.

  Article 2 The term “Civilized construction” herein refers to taking measures as required during the construction of projects and the demolition of buildings and structures to ensure the operating environment, city appearance and environmental sanitation, and the health of construction workers at construction sites, and to effectively reduce construction activities that adversely affect the surrounding environment.

  Article 3 These Rules shall apply to the relevant activities of project construction and demolition of buildings and structures within the administrative area of this Municipality, as well as the supervision and management thereof.

  The Rules are not applicable to rescue and disaster relief projects, or railway/military construction projects.

  Article 4 The municipal urban management authority is responsible for the organization and coordination of project management of the civilized construction in this Municipality, and organizes the implementation of these Rules.

  The municipal urban management authority has provided a civilized construction related reporting hotline (12319), and established a mechanism for information exchange and quick handling of complaints between the project management authorities.

  Article 5 The authorities in charge of construction, water affairs, forestry and landscaping, and ports (hereinafter collectively referred to as the project management authorities), etc. shall be responsible for the supervision and management of the civilized construction of construction projects respectively according to the following duties:

  (1) The construction authority is responsible for the civilized construction of housing construction and municipal infrastructure projects, and the supervision and management of the occupation and excavation of urban roads.

  (2) The water affairs authority is responsible for the supervision and management of the civilized construction of water affairs projects.

  (3) The forestry and landscaping authority shall be responsible for the supervision and management of the civilized construction of landscaping projects.

  (4) The port authority is responsible for the supervision and management of the civilized construction of port and terminal projects.

  (5) The road authority is responsible for the supervision and management of the civilized construction of highway projects.

  The urban management and law enforcement authority and the project management authorities shall be responsible for the administrative punishment of relevant illegal acts according to law.

  Article 6 Each project management authority shall establish a civilized construction inspection system, keep inspection records, and include the enterprises’ implementation of civilized construction management into the enterprises’ comprehensive integrity evaluation system.

  Article 7 Construction developers shall perform the following management responsibilities:

  (1) When inviting bids for construction projects and building and structure demolition projects or directly contract awarding, define the requirements and measures for civilized construction, and separately list the expenses for safe and civilized construction measures.

  (2) When compiling project estimates and budgets, specify the expenses for safe and civilized construction measures and the terms related to application, review, payment and settlement in the contracts in accordance with relevant national regulations.

  (3) When applying for construction permits, provide construction contracts and relevant documents on safe and civilized construction measures.

  (4) Before the confirmation of the construction project design documents, organize the design unit to conduct on-site surveys on the buildings, structures and various pipelines and facilities around the project, put forward specific technical measures and requirements for civilized construction, and submit the written opinions of the management organizations of the buildings, structures, pipelines and facilities involved in the project and the design requirements put forward by the environmental protection authority to the design entity, the construction contractor and the road management and maintenance entity.

  (5) Ensure the expenses for safe and civilized construction measures, inspect, urge and assist the construction contractor to implement civilized construction, and restrain from requiring the construction contractor to implement construction below the standards for civilized construction.

  Article 8 When compiling design documents, the design entity shall, according to the construction project survey documents and the written opinions on civilized construction provided by the construction developer, put forward protection requirements for the buildings, structures and various pipelines and facilities around the construction project, and give priority to the construction techniques and processes and building materials beneficial to civilized construction.

  Article 9 Construction contractors shall perform the following management responsibilities:

  (1) According to the requirements of the Rules, implement various civilized construction management measures, identify the responsible person for civilized construction, and establish a civilized construction inspection system.

  (2) For construction projects subject to general construction contracting management, each subcontractor shall abide by the management regulations of the general contractor, and implement the civilized construction management responsibility of the subcontracted works.

  (3) According to the written opinions of the construction developer on civilized construction and the requirements of the design documents, specify the specific measures for civilized construction in the construction organization design documents, and submit them to the supervision entity for review and confirmation before implementation.

  Construction contractors shall correct the violations of the Rules in construction activities timely.

  Article 10 For projects under supervision, supervision entities shall perform the following management responsibilities:

  (1) Review the construction organized design documents drawn up by the construction contractor, urge the construction contractor to implement the civilized construction management measures, and review and confirm the construction contractor’s use conditions of the expenses for civilized construction measures.

  (2) During the implementation of supervision, where the construction contractor is found to have violated the regulations on civilized construction management, the supervision entity shall request the construction contractor to make corrections; where the construction contractor refuses to make corrections, the supervision entity shall request the construction contractor to suspend the construction work and report to the construction developer.

  (3) Where the construction contractor refuses to make corrections or continues the construction after being found to have violated civilized construction management regulations, the supervision entity shall report to the project management authorities timely.

  For projects that do not need to be supervised according to laws and regulations, the construction developer shall perform the management responsibilities specified in the preceding paragraph.

  Article 11 The construction developer shall post construction start notices around the site 7 days before the start of the project. The notice shall include the project overview, construction plan, names of the responsible entities of all parties involved in the construction, name of project leader, telephone number for complaints and reports, etc.

  For construction projects occupying urban roads that have a greater impact on traffic, the construction developers shall formulate traffic organized diversion plans, emergency plans and road repair plans, and publish construction notices, temporary bus adjustments and other information through television stations, newspapers, radio stations and other media at the municipal level or above.

  Article 12 Relevant facilities shall be set at the construction site as follows:

  (1) Set construction nameplates in conspicuous positions and post relevant permits. The construction nameplate shall specify the project name, the name of the construction developer, the construction contractor and the supervision entity, the name of the project leader, the name of the supervision entity, the start date of construction, the planned completion date, the telephone number for supervision and complaints, etc.

  (2) The construction operation area shall be set up separately from the office and living areas, with a sufficient safety distance, and corresponding isolation measures shall be taken; where urban roads are occupied or excavated for construction, unnecessary areas and facilities such as office space and dormitory shall not be set up.

  (3) Continuous and closed enclosures shall be set up around the construction site. For construction projects such as pipeline projects and non-fully enclosed urban road projects, road fences shall be used.

  (4) Car wash sites and sedimentation tanks shall be set up at the vehicle entrances and exits of construction sites, and high-pressure washing guns shall be equipped; for construction projects such as pipeline projects and non-fully enclosed urban road projects without car washing facilities, the construction contractors shall use mobile washing equipment to rinse vehicles at construction sites, and arrange workers for the cleaning work.

  (5) The scaffolding on the facade of the construction site shall be erected with steel pipes, and the use of bamboo or a mix of steel and bamboo shall be prohibited. The scaffolding rod shall be painted with warning paint of the specified color, and there shall be no obvious rust. The facade shall be uniformly enclosed with green dense mesh safety nets.

  (6) The building materials, equipment and facilities at the construction site shall be neatly stored in the area delineated by the general construction plan, and provided with labels, and shall not be stacked outside the enclosure of the site.

  (7) The roads at the construction site shall be unblocked, and unblocked drainage facilities and emergency facilities shall be set up.

  Article 13 Construction contractors shall prevent construction noise pollution in accordance with the relevant regulations on the prevention and control of environmental noise pollution, and the noise emission shall not exceed the national and local noise emission standards. Construction contractors shall monitor the noise level generated at the construction sites in accordance with the measurement methods for noise within the scope of the construction site.

  Article 14 Construction contractors shall abide by the following regulations on the prevention and control of fugitive dust:

  (1) Bulk cement or commercial concrete shall be used in construction projects; where it is necessary to use bagged cement due to the restrictions of objective conditions such as traffic and construction sites, it shall be approved by the construction authority.

  (2) Dust-proof measures such as sealing or covering shall be adopted for the bulk building materials stacked at the construction site.

  (3) It is forbidden to throw construction waste high up in the air, and construction waste shall be cleared, transported and disposed timely in accordance with the relevant regulations of this Municipality.

  (4) The transportation of bulk materials shall comply with the relevant regulations on the management of bulk materials in this Municipality.

  (5) The measure of spraying for dust removal shall be adopted during the construction of demolition projects. For the construction land where construction cannot be started within 30 days after the demolition completion of the demolition project, the construction developer shall take such measures as covering, ground hardening and simple greening.

  (6) When loading and unloading bulk building materials or there is flying dust at the construction site, such measures as blocking and enclosure or spraying for dust reduction shall be taken.

  (7) It is forbidden to burn construction waste and domestic waste.

  Article 15 Developers shall apply to the water affairs authority for going through the permission procedures for construction drainage, and conduct temporary drainage connection as required.

  A sedimentation tank and a drainage ditch (pipe) network shall be set up at the construction site. And it is forbidden to directly discharge the mud from the construction site into the urban drainage pipe network or the river course.

  Article 16 Where construction contractors conduct electric welding operations or use lighting for construction at night, they shall take effective measures to shield the light to avoid direct lighting on residential buildings.

  Except for meeting the nighttime security needs of the construction site, the construction site shall stop using strong light sources from 22:00 at night to 6:00 on the next morning.

  Article 17 When carrying out construction work on urban roads, the construction contractor shall carry out the work within the approved road section and time, set obvious safety warning signs and take protective measures at a spot at a safe distance from the construction site in the direction of oncoming vehicles.

  When carrying out road maintenance and repair work on urban roads, standardized safety warning signs and safety protection facilities shall be set as required. Vehicles and machinery for road maintenance work shall be equipped with warning lights, and sprayed with obvious signs and patterns, and the warning lights and hazard warning flashers shall be turned on during work.

  Where a construction project is adjacent to a sidewalk or a roadway, the construction contractor shall build safety protection facilities above the road, and set warning and guiding signs.

  Article 18 Construction developers and construction contractors shall ensure the safety and security of the construction sites, and implement the anti-theft and fire prevention measures.

  Article 19 In the construction process, construction contractors shall conduct the follow-up visit and re-visit work on the impact of the construction on the surrounding entities and communities, and improve the civilized construction work according to the feedback.

  Article 20 Construction contractors shall create civilized construction files to record the civilized construction conditions.

  Article 21 After the completion of a construction project, the construction contractor shall dismantle the enclosure, safety protection facilities and other temporary facilities of the construction site, and clear and transport wastes before the construction developer organizes the completion acceptance.

  After the construction project of occupation and excavation of urban roads is completed, the construction contractor shall remove obstacles on the roads, eliminate potential safety hazards, and clear the site before the approved construction period expires.

  Article 22 The specific standards for civilized construction of construction projects shall be implemented in accordance with the Standards of Guangzhou Municipality on Civilized Construction of Construction Projects attached to these Rules; where adjustments are required, the municipal construction authority will organize to revise and announce the standards.

  The municipal construction authority, together with the project management authorities, has established a civilized construction evaluation system in this Municipality, and will organize the evaluation of civilized construction of enterprises, submit the evaluation results to the municipal urban management authority for review, and announce such results to the public.

  Article 23 Any entity or individual has the right to report construction behaviors that violate the Rules.

  Article 24 Where the construction developer or the design entity fails to perform the management responsibilities to ensure civilized construction as stipulated in Articles 7 and 8 herein, the project management authorities shall order it to make corrections; where it fails to make corrections within the time limit, a fine ranging from RMB 5,000 to RMB 10,000 shall be imposed, and the case will be recorded in the civilized construction evaluation files for enterprises.

  Article 25 Where the supervision entity or the construction developer fails to perform the civilized construction management responsibilities stipulated in Article 10 herein, the project management authorities shall order it to make corrections; where it fails to make corrections within the time limit, the project management authorities will impose a fine ranging from RMB 5,000 to RMB 10,000.

  Article 26 Where the construction developer fails to make an announcement in accordance with the provisions of Article 11 herein, the project management authorities shall order it to make corrections and impose a fine ranging from RMB 5,000 to RMB 20,000.

  Article 27 Where the construction contractor violates Items (1), (2), (5), (6) and (7) of Article 12 herein, resulting in the failure of the construction site facilities to meet the requirements, the project management authorities shall order it to make corrections; where it fails to make corrections within the time limit, a fine ranging from RMB 5,000 to RMB 20,000 will be imposed.

  Article 28 Where the construction contractor violates the lighting requirements stipulated in Article 16 herein, the urban management and law enforcement authority shall order it to make corrections; where it fails to make corrections within the time limit, a fine ranging from RMB 5,000 to RMB 20,000 will be imposed.

  Article 29 Where the construction contractor violates Items (3) and (4) of Article 12, Article 14 and Article 17 herein, the urban management and law enforcement authority will impose administrative penalties according to the division of labor determined in the Detailed Rules of Guangzhou Municipality on Urban Management and Law Enforcement.

  For other illegal acts in violation of these Rules, if the laws, regulations and rules have provisions for punishment, the relevant authorities shall make punishment in accordance with such provisions.

  Article 30 Where the relevant authorities and their staff fail to perform their duties in accordance with the law, the appointment and removal authority or the supervisory authority shall impose administrative sanctions on the directly responsible person in charge and other directly responsible persons in accordance with the administrative authority; the judicial authority shall investigate them for criminal responsibility according to law if a crime has been constituted.

  Article 31 These Rules shall come into force on March 1, 2012.

  Annex

  Standard of Guangzhou Municipality on Civilized Construction of Construction Projects

  1. Construction enclosure

  1.1. Enclosing wall

  1.1.1. Housing construction projects, public works and water works with a construction period of more than half a year, and demolition projects of buildings and structures shall be enclosed by walls.

  1.1.2. A brick wall with a thickness of 18 cm, a height of 2 meters and coping shall be used uniformly.

  1.1.3. Foundation footing and wall columns shall be built, the depth of the foundation footing shall not be less than 50 cm, the distance between the wall columns should not exceed 3 meters, and the connection between the wall columns and the wall shall be firm, safe and reliable.

  1.1.4. The exterior walls shall be plastered, trowelled and beautified, and it is encouraged to adopt characteristic shapes and green exterior walls for construction projects.

  1.1.5. Those who use the wall to place commercial advertisements and public service advertisements shall abide by the relevant provisions of the Advertisement Law of the People's Republic of China, Measures of Guangzhou Municipality for the Management of the Setting of Outdoor Advertisements and Signboards, etc.

  1.2. Hoarding

  1.2.1. Public works, water works and demolition works with a construction period of less than half a year and more than 15 days should be enclosed with hoarding.

  1.2.2. Light-duty steel frame aluminum gusset plates (molded plates) or prefabricated double-sided color steel sandwich boards (boards for board rooms) shall be used, with a height of 1.8 meters, the hoarding boards shall be supported by angle steel, and consolidated with the ground through C-shaped steel columns. The distance between the steel columns shall not be more than 3.3 meters.

  1.2.3. The enclosure foot line shall uniformly use brick walls with a height of 20 cm and a thickness of 18 cm to prevent residual mud and debris from leaking out of the enclosure.

  1.2.4. The connection of columns, supports and arc-shaped colored profiled steel plates must be firm, safe and reliable, and the color of the hoarding boards shall be consistent.

  1.2.5. Finished cast iron or steel anti-collision bars shall be installed for the enclosure near motor vehicle lanes, and night-time reflective warning signs shall be installed in accordance with relevant traffic management regulations.

  1.3. Closely-buckled steel fence (moving fence).

  Public works and water works with a construction period of less than 15 days should be enclosed by standard closely-buckled steel fences (moving fences).

  2. Entrance and exit of the construction site

  2.1. The gate and gate post of the construction site shall be firm and aesthetic, whose height shall not be less than 2 meters, and width not be less than 5 meters.

  2.2. The materials used for the gate shall be compatible with the enclosing walls and fences, and there shall be a corporate logo on the gate.

  3. Site management

  3.1. The following hardening measures shall be adopted at the construction site.

  3.1.1. Concrete with a thickness of not less than 20 cm and a strength of not less than C15 shall be poured into areas such as the inner and outer gate passages of the construction site, indoor floors of temporary facilities, material storage yards, steel bar processing yards, and warehouse floors.

  3.1.2. Greening measures shall be taken for the land at the construction site to be laid bare for more than 3 months; dust suppression measures such as covering, compaction and watering shall be taken for the land to be laid bare for less than 3 months.

  3.2. Temporary facilities (offices, dormitories, kitchens, toilets, temporary water and electricity facilities and warehouses) set up at the construction site shall be uniformly prefabricated rooms or brick rooms.

  The prefabricated rooms used at the site shall have a conformity certificate. For temporary brick rooms, brick walls and zinc-iron tile roof shall be uniformly used, the inside and outside of the walls shall be plastered are whitewashed, and the roof shall be reinforced against typhoons.

  3.3. The construction site shall have a circulating main road, which shall be kept unobstructed regularly, no components and materials shall be stacked on the road, and the road shall be flat and solid without large-scale water accumulation. The motor vehicle passage should not be less than 3.5 meters in width, and a drainage ditch shall be set on the outside of the passage.

  3.4. The vehicle entrances and exits at the construction site shall be provided with a rectangular car wash site (3 m wide and 5 m long) and sedimentation tank that are constructed with vibrated concrete and surrounded by a ditch (30 cm wide and 40 cm deep). High-pressure washing guns shall be equipped, and motor vehicles leaving the construction site shall be rinsed before being driven out. For municipal and pipeline projects without car washing facilities, the construction contractor shall use mobile washing equipment to rinse the vehicles at the construction site, and arrange for workers to do cleaning work.

  3.5. A drainage ditch (pipe) network shall be set up to ensure smooth drainage. The waste water and mud from project construction shall flow to the sump at the construction site for unified precipitation and treatment through the flume or pipeline, and shall not be discharged at will to pollute the rivers and roads outside the construction area.

  3.6. The safety net shall be hung flat, closely connected, neat and aesthetic, and shall not be missing or come off. The facade enclosure used in the demolition projects shall be dust-tight, and the color should be coordinated with the surrounding environment.

  3.7. Closed management shall be implemented at the site.

  3.7.1. There shall be full-time security guards at the entrances and exits and a security guard management system to effectively give play to the role of guards.

  3.7.2. Personnel entering the construction site shall wear work cards such as “construction project safety card”, and work cards shall be neatly worn.

  3.8. Office space and dormitory shall not be set up in the construction area where municipal roads are occupied with approval.

  4. Living facilities

  4.1. The living area shall be provided with the following facilities: pantry, washbasins and shower room, flush or mobile toilets, closed garbage container, etc. During construction in summer, heatstroke prevention and cooling equipment and facilities such as tea kiosks and tea buckets shall be provided.

  4.2. Kitchen

  4.2.1. Where a collective kitchen is set up at the construction site, it shall be far away from the building scaffolding, workplaces, sewage ditches and other pollution sources. The kitchen shall be ventilated, hygienic, and always kept clean. The raw food room and the cooked food room shall be separated. The interior walls shall be covered with white tiles with a height of 2 meters, and the other parts of the walls shall be trowelled and plastered. The stoves and workbenches in the kitchen, as well as the inner and outer window sills of the food sales windows, shall also be covered with white tiles. The doors, windows and openings shall be provided with screens, and the floor shall be well drained.

  4.2.2. Canteen buildings and canteen hygiene shall meet relevant hygiene requirements. For example, cooks shall have a medical certificate issued by the health and epidemic prevention department, raw food and cooked food shall be stored separately, canteen cooks shall wear white work clothes, and canteen hygiene shall be regularly inspected.

  4.2.3. The signboard of hygiene responsibility system shall be put up in a conspicuous place of the canteen, and the responsible person shall be determined.

  4.3. Dormitory

  4.3.1. The dormitories shall be moisture-proof and ventilated, and have proper lighting, and the per capita bed area shall not be less than 1.7 square meters, and the beds shall be properly partitioned.

  4.3.2. There shall be a direct entrance and exit for every 25 people, and the width of the main passage shall not be less than 1.2 meters.

  4.3.3. The door width of the dormitory where more than 15 people live shall not be less than 1.2 meters.

  4.3.4. Male and female dormitories and bathrooms shall be able to meet the needs during the construction peak.

  4.3.5. The internal facilities of the workers’ dormitories shall be neat and clean, and the daily necessities shall be stored in a unified manner.

  4.3.6. There shall be a management system for the dormitories, and the responsible person for public security, fire prevention and hygiene management shall be appointed.

  4.4. Toilet

  4.4.1. Wash basins, automatic toilet flushing equipment, and septic tanks with covers shall be provided, and it is forbidden to directly discharge feces into sewers and rivers.

  4.4.2. White tiles with a height of 1.5 meters shall be laid as the inner wainscot, white tiles shall be laid on the bottom and sides of the toilet bowls, and the floor and squatting platforms shall be plastered with cement slurry.

  4.4.3. The toilets shall be cleaned by a specially designated person and disinfected regularly without peculiar smell, and shall be kept clean and hygienic.

  5. Construction site signage

  5.1. There shall be neat and obvious “five sign boards and one general plan” at the entrance of the construction site:

  Project overview signboard; management personnel list and supervision telephone signboard; fire protection signboard; safe production signboard; civilized construction signboard and the general plan of the construction site.

  5.2. The signboards shall be produced and hung in a standardized and orderly manner, and the fonts shall be neat.

  5.3. Newspaper reading boards, blackboard newspapers and other publicity areas shall be set up at the construction site to enrich the learning content and praise good deeds.

  6. Noise pollution control

  6.1. Where various pile drills, drilling machines, mixers, bulldozers, excavators, hoists, oscillators, electric saws, electric planers, sawing machines, pneumatic tools and other construction machinery cause environmental noise pollution at the sites of construction, decoration, municipal projects and demolition within the urban administrative streets and urban noise control range, the operating time shall be limited to 6:00 to 22:00, except for emergency repairs and emergency works.

  6.2. Operating equipment such as concrete transfer pumps, large air compressors and diesel generators that are prone to noise shall be set on the side of the construction site as far away from residential areas as possible, and operate in temporary rooms and sheds with the sound insulation function. For construction sites less than 5 meters away from buildings such as residences, hospitals and schools, enclosures with the noise reduction function shall be set up.

  6.3. Where the blasting operation is required, it shall be carried out within the specified time after being approved by the public security organ.

  7. Dust pollution control

  7.1. Where storage equipment such as tanks (cylinders) for bulk cement and mortar is placed at the construction site, the owner of the equipment shall be responsible for submitting a registration form to the bulk cement management institution.

  7.2. The earth at the construction site shall be placed in a concentrated manner, and covering or hardening measures shall be taken for 100% of the earth.

  7.3. The measure of water spraying for dust reduction shall be taken for the demolition projects. When the wind speed may reach Scale 5 according to the weather forecast, the demolition projects shall be stopped. The muck shall be cleared and transported within 3 days from the date of completion of the demolition, and the relevant regulations on the management of the demolition project shall be complied with.

  8. Health care and first aid

  8.1. A medical room shall be set up for construction sites with more than 500 people, and an effective medical first aid kit shall be provided for other construction sites.

  8.2. There shall be trained and qualified first-aid personnel at the construction site who have general first-aid treatment knowledge.

  8.3. In order to protect the health of workers, publicity and education on hygiene and disease prevention shall be carried out regularly during epidemic seasons and normal times.

  9. Disposal of construction waste and domestic waste

  9.1. A closed garbage station shall be set up at the construction site, and garbage shall be stored in a classified manner in accordance with the relevant regulations of the municipal urban management authority on the management of garbage classification.

  9.2. Household garbage shall be cleaned up in time, transported in a centralized manner, placed into containers and managed by special personnel.

  9.3. Toxic and harmful substances shall not be burned on site, and the disposal of toxic and harmful substances shall be carried out in accordance with relevant regulations.

  10. Civilized construction standards for temporary construction projects, low-rise residential buildings built by farmers and other small projects with a total investment of less than RMB 300,000 or a floor area of less than 300 square meters

  10.1. The projects shall be surrounded by blue corrugated boards, and the facade shall be protected by green safety nets.

  10.2. The construction time is limited to 6:00 to 22:00 every day.

  10.3. The discharge of residual mud or solid waste from construction shall conform to the relevant regulations of this Municipality, and the transport vehicles shall be rinsed before being driven out of the construction site.
