Interim Measures of Guangzhou Municipality for the Administration of Guangzhou Airport Economic Zone

  (Issued on December 30, 2015 in accordance with Decree No. 137 of the People's Government of Guangzhou Municipality and amended on September 5, 2017 in accordance with Decree No. 152 of the People's Government of Guangzhou Municipality)

  Article 1     These Measures are formulated in accordance with relevant laws and regulations, on the basis of the actual conditions of the Municipality and with a view to promoting the construction and development of Guangzhou Airport Economic Zone.

  Article 2     These Measures are applicable to the administration within the key development areas in Guangzhou Airport Economic Zone.

  The zoning of the aforesaid key development areas shall be done according to relevant plans of the Municipality.

  Article 3     The Management Committee of Guangzhou Airport Economic Zone (hereinafter referred to as “the Management Committee”), as a dispatched agency of the municipal people’s government, shall exercise municipal-level administrative powers in key development areas, be responsible for overall planning, development and construction, investment invitation and attraction, administrative approval, project preparation and serving enterprises, and provide social management and public services for economic development and park construction.

  Article 4     The municipal people’s government and the government sectors thereof as well as district people’s governments and the government sectors thereof shall delegate the following administrative powers within the key development areas to the Management Committee:

  (1) The examination and approval of regulatory plans, the examination and approval of repossession of State-owned land use right, the issuance of (or change in) approvals of use of land for construction, the examination and approval of the grant/allocation of land-use right, the examination and approval of idle land disposal plans, etc., which are in the charge of the municipal people’s government.

  (2) The examination and approval of the naming of, any change in the name of, or the cancellation of the name of any non-residential place, which is in the charge of the municipal people’s government, except for the examination and approval of the geographical names of any cross-district roads, bridges, tunnels or physical geographic entities or the application for any geographical names preceded by “China”, “All-China”, “Central”, “Guangdong”, or “Yue (another name for Guangdong)” or otherwise involving the name of any country or province; the examination and approval of the naming of, any change in the name of or the cancellation of the name of any non-residential place, which is in the charge of a district people’s government.

  (3) The examination and approval of government-invested projects, the approval of enterprise-invested projects, the approval of the mode and scope of tendering for capital construction projects and franchising projects, the filing of enterprise-invested projects (including commodity housing construction projects), etc., which are in the charge of development and reform authority, except for the projects fully or partially invested with municipal-level-only funds, involving comprehensive balancing throughout the Municipality and requiring municipal unified planning and construction.

  (4) The examination and approval of and the filing of foreign-invested enterprises encouraged or permitted, the licensing of factory vehicles of foreign-invested enterprises and processing enterprises for self-shipment directly from and to Hong Kong or Macao, the examination and approval of processing trade businesses, etc., which are in the charge of the commerce authority.

  (5) The filing of technology improvement projects in the industrial field, which is in the charge of the industry and information technology authority.

  (6) The preparation of regulatory plans, the issuance of opinion letters for construction project site selection, permits for construction land planning, permits for construction project planning (including approvals of site plans), certificates of acceptance of construction project planning, preliminary examination reports for construction land, the provision of professional planning opinions for investigation of illegal construction, the handling of matters concerning legal land expropriation, etc., which are in the charge of the land resources and planning authority.

  (7) The examination and approval of the occupation or excavation of urban roads, the examination and approval of the occupation, excavation, relocation or reconstruction or other urban infrastructures, the issuance of construction permits for building projects, the examination and approval of the use of bagged cement for construction projects, the examination of preliminary designs of large and medium-scale construction projects, the examination and filing of shop drawing design documents (including the filing of results of examination of energy conservation designs for civil buildings), the filing of final acceptance of construction projects, the filing of tendering documents for and implementation of tendering and bidding for building projects, the issuance of permits for pre-sale of commodity houses, the supervision and administration of proceeds from pre-sale of commodity houses, etc., which are in the charge of the construction authority.

  (8) The examination of designs of public drainage facilities, the examination and approval of preliminary designs of water supply or water conservancy capital construction projects, the issuance of urban drainage permits, the examination and approval of commencement of construction of water supply and drainage works, the examination and approval of relocation, reconstruction or occupation of public drainage facilities, the examination and approval of plans for and final acceptance checks of water and soil conservation of productive construction projects, etc., which are in the charge of the water affairs authority.

  (9) The examination and approval of environmental impact assessment documents for construction projects, the acceptance checks of pollution prevention and control facilities, etc., which are in the charge of the environmental protection authority.

  (10)   The examination and verification of aerial defense basement projects required for civil buildings, the filing of final acceptance of civil air defense works, etc., which are in the charge of the civil air defense authority.

  (11)   The examination and approval of erection of outdoor advertising facilities, which is in the charge of the urban management authority, except along the expressway to the airport.

  (12)   The examination and approval of temporary occupation of greenbelts for urban-rural development or urban-rural infrastructure maintenance, the examination and approval of harvesting, relocation and trimming of trees, and the examination and approval of preliminary designs of greening projects, which are in the charge of the forestry and landscaping authority.

  (13)   The licensing of operation (including change) of bus and tram lines, which is in the charge of the transportation authority.

  (14)   The issuance of hygienic licenses for public places, the issuance of hygienic licenses for water suppliers, etc., which are in the charge of the health and family planning authority.

  (15)   The acceptance of and the review of applications for naming of residential places and non-residential places, which are in the charge of the civil affairs authority.

  (16)   The finalization of urban renewal block planning schemes and renewal project implementation schemes, which is in the charge of the municipal urban renewal leading group, and the preparation and review of urban renewal block planning schemes and renewal project implementation schemes, which is in the charge of the urban renewal authority.

  If any of the aforesaid administrative powers within the key development areas was originally delegated or entrusted by the municipal people’s government and the government sectors thereof to the local district people’s government and the government sectors thereof, it shall be taken back and delegated to the Management Committee.

  Article 5    When entrusting items subject to administrative examination and approval, the municipal people’s government and the government sectors thereof as well as district people’s governments and the government sectors thereof shall also entrust the exercise of appropriate administration and enforcement to the Management Committee, except for the comprehensive enforcement items for urban management.

  The comprehensive enforcement for urban management in the key development areas shall be in the charge of the municipal bureau of comprehensive enforcement for urban management, and undertaken by Guangzhou Airport Economic Zone Branch of the municipal bureau of comprehensive enforcement for urban management.

  The comprehensive administration of work safety of enterprises with legal person status within the key development areas shall be in the charge of the work safety authority subordinate to the Management Committee, and the comprehensive administration of other work safety shall be in the charge of the local district work safety authority.

  Article 6     The details of the items subject to administrative examination under Article 4 hereof and of the entrusted administration and enforcement under Article 5 hereof shall be clearly specified in the entrustment agreements between the Management Committee and the municipal people’s government as well as the municipal/district government sectors thereof. The government sectors so entrusted shall guide and supervise the administrative examination and approval and/or filing by the Management Committee.

  Article 7     Before the examination and approval of the initiation, planning and land use for a cross-regional or cross-border construction project that requires occupation of land in any key development area, the development and reform authority or the land resources and planning authority shall seek opinions from the Management Committee. Before the examination and approval of the initiation, planning and land use for a construction project that is within any key development area and requires occupation of any other area in the Airport Economic Zone, the Management Committee shall seek opinions from the local district people’s government.

  Article 8     The Guangzhou Airport Economic Zone Investment Service Center set up by the Management Committee shall be responsible for relevant investment and government services.

  The entrusted items subject to administrative examination and approval as accepted by the Management Committee shall practice one-stop acceptance, centralized approval, time limit, tracking service and other systems. The Management Committee shall further simplify the examination and approval processes and shorten the time examination and approval on the basis of the time limit for examination and approval prescribed by the Municipality.  

  The Management Committee shall coordinate the establishment of agencies at or dispatching of personnel to the investment service center with district customs, inspection and quarantine and border inspection authorities and municipal taxation, industry and commerce, quality supervision, public security, health and family planning and meteorology authorities.

  Article 9     The Municipality shall build a mechanism for communication, coordination and notification within the key development areas, with the Management Committee taking the lead and the joint involvement of the local district people’s government and the municipal government sectors to regularly communicate important information, timely coordinate major issues, and identify the solutions and responsibilities of the parties concerned. As for major matters affecting the construction and management within the Zone, the Management Committee will circulate a notice thereof to the corresponding extent.

  Article 10   The Management Committee may make use of the land, productive assets and fiscal funds in the key development areas to build an investment and financing system, and raise funds by means of market-based operation for development and construction.

  The Management Committee may organize a Guangzhou Airport Economic Zone development enterprise according to law to participate in the primary land development, infrastructure construction and key project investment in the key development areas, and participate in the investment in other high-quality projects outside the Zone. The Management Committee shall perform its duties as an investor according to law.

  Article 11   Guangzhou Airport Economic Zone shall set up a treasury. And the Management Committee, with an independent financial management power, shall be responsible for treasury management and prepare fiscal budgets for the key development areas and the fund budgets for the Management Committee. The plan for the fiscal system of Guangzhou Airport Economic Zone shall be formulated separately by the municipal finance authority.

  The Management Committee shall establish a management system with separate lines for income and expenditure and centralized payment, and strictly abide by relevant national, provincial and municipal regulations on financial administration.

  Article 12   From January 1, 2016, the proceeds from transfer of additionally purchased or served lands in the key development areas, after deduction of reservation or purchasing costs and policy-related funds to be withdrawn, shall be shared between the Management Committee and the local district people’s government equally; in the case of a stock land, such an allocation shall be made according to the original allocation system.

  The Management Committee shall establish an accounting system for land transfer and development costs and revenues, and shall be subject to the guidance and supervision by the land resources authority and the finance authority.

  The Management Committee may separately formulate incentive measures with respect to the land expropriation and housing demolition and relocation by the local district people’s government.

  Article 13   The Management Committee shall actively coordinate with relevant municipal government sectors to explore the optimization of the tax collection and management mechanism and procedures within the key development areas and to create a favorable tax environment for the development of industries with the characteristics of Guangzhou Airport Economic Zone.

  Article 14   Taking 2015 as the base year, and from January 1, 2016, the additional tax revenues from the key development areas, after deduction of the part required to turned over to upper authorities, shall be shared between the Management Committee and the local district people’s government equally; the part of the stock tax revenues of 2015 that was originally attributable to the Municipality shall be allocated to the Management Committee, while the part that was originally attributable to a district people’s government shall be still enjoyed by the district people’s government.

  Article 15   The Management Committee shall formulate plans, guiding catalogues and entry conditions to promote the development of characteristic aviation-related industries, such as aviation logistics, airplane repair, financing lease, headquarter economy, high-end manufacturing and international trade.

  The Management Committee may formulate support policies to encourage the development of key industries, and organize the implementation of such policies.

  The Management Committee may, together with the local district people’s government, provide support and incentives for enterprises in the key development areas according to law.

  Article 16   The Management Committee shall coordinate with the customs, the inspection and quarantine authority and the airport to innovate in customs, inspection and quarantine and other regulatory systems and promote the joint development of industries inside and outside the network/Zone on the basis of safety and easy entry and exit of goods.

  The Management Committee shall coordinate with the customs and the inspection and quarantine authority to jointly implement the IT construction of Baiyun Airport Comprehensive Bonded Zone to promote the integration and effective utilization of public information resources in the Zone, implement the quick customs release mechanism and the new mode of regulation on the international transit of goods, implement the mode of intelligent inspection-based port management, and improve customs clearance efficiency.

  Article 17   The land quota for the key development areas shall be specially transmitted to lower levels by the municipal people’s government, and be subject to the overall planning and arrangement by the Management Committee.

  The Management Committee may develop and utilize, by means of land use right leasing, cooperation, mortgage and the like, the untransferred State-owned lands in the key development areas.

  Article 18   The Management Committee may establish a target appraisal system to conduct performance management and improve the efficiency of management.

  Article 19   These Measures shall become effective as of November 1, 2017.
