Decision of the People’s Government of Guangzhou Municipality on Announcing the Retained, Cancelled or Adjusted Administrative Approval/Filing Items
(Issued on September 15, 2010 in accordance with Decree No. 38 of the People’s Government of Guangzhou Municipality and amended on September 30, 2015 in accordance with Decree No. 132 of the People’s Government of Guangzhou Municipality)
According to the Outline of the Reform and Development Plan for the Pearl River Delta (2008-2020) and the Notice of General Office of the People’s Government of Guangdong Province on Forwarding the Opinions of Guangdong Provincial Development and Reform Commission and Other Relevant Authorities on Further Deepening the Reform of the Administrative Approval System (Yue Fu Ban (2009) No. 1), the municipal people’s government has carried out a thorough clearance and scrutiny on the administrative approval/filing items currently implemented by municipal government sectors. After strict review and demonstration, the municipal people’s government has decided to retain 275 administrative approval items and 89 filing items, cancel or adjust the management methods for 566 administrative approval items and 200 filing items.
All district people’s governments and all municipal government sectors shall further transform government functions and strive to improve the economic adjustment, market regulation, social management and public service capabilities. Specifically, the cancellation of the approval/filing items to be cancelled shall be implemented and supervised; for the approval/filing items for the self-discipline management of transfer of industry organizations, efforts shall be made in cooperation, communication and link-up, and such items needed to be transferred to corresponding industry organizations timely; for the approval items for the transfer of general business management, regulatory measures shall be taken in accordance with the laws, and management methods shall be innovated; for approval /filing items delegated to subordinate authorities (except for the approval/filing items delegated subject to hierarchical management), all municipal government sectors shall no longer implement approval/filing but shall strengthen supervision and guidance for the downward shift of management focus; the items that needed to be forwarded to the People’s Government of Guangdong Province or the State Council for approval shall be forwarded within the statutory time limit and as per statutory methods and requirements; for the approval/filing items to be retained, the approval efficiency and quality shall be further improved; for the items entrusted and devolved by the provincial authorities, the approval/filing shall meet the corresponding entrustment and devolvement requirements.
The municipal legislative affairs office shall establish a dynamic management system for administrative approval/filing items on its portal website (www.gzlo.gov.cn) to announce to the public the approval/filing items subject to retainment/cancellation or subject to changes in management methods and the legal basis thereof, and shall number item by item the administrative approval/filing items to be retained, be submitted to the People’s Government of Guangdong Province or the State Council for approval according to relevant procedures or be entrusted and devolved by the People’s Government of Guangdong Province to facilitate public inquiry. In the future, for any newly added administrative approval/filing item, the competent authority responsible for the implementation shall report it to the municipal legislative affairs office for review and announcement, and incorporate it into the management system for unified numbering, otherwise the approval/filing shall not be implemented. The municipal government affairs management office and the municipal supervisory bureau shall incorporate the approval/filing items subject to numbering into the government service platform and the electronic monitoring system for real-time monitoring, so as to continuously improve the approval/filing efficiency.
