Rules of Guangzhou City on the Local Chronicles Work
(Issued on November 7, 2011 in accordance with Decree No. 60 of the People’s Government of Guangzhou Municipality and amended on September 30, 2015 in accordance with Decree No. 132 of the People’s Government of Guangzhou Municipality)
Article 1 In order to compile local chronicles comprehensively, objectively and systematically, develop and utilize local chronicles resources scientifically and rationally, and give full play to the role of local chronicles in managing national affairs, preserving history and educating people, theseRules are developed in accordance with the Regulations on the Local Chronicles Work and the Rules of Guangdong Province on the Local Chronicles Work and on the basis of the actual conditions of this Municipality.
Article 2 The term “local chronicles” herein includes local chronicles and local comprehensive yearbooks.
Article 3 These Rules shall apply to the local chronicles work within the administrative area of this Municipality.
Article 4 The municipal/district people's government shall strengthen its leadership over the local chronicles work in its administrative area, and incorporate the local chronicles work into local economic and social development plans, annual work plans and annual work assessment. The funds needed for the local chronicles work are included into its financial budget.
Article 5 The municipal/district local chronicles authority shall be responsible for organizing and implementing the local chronicles work in its administrative area and perform the following duties:
(3) Organizing, guiding, inspecting, supervising and assessing the local chronicles work;
(5) Organizing the investigation and study of regional information,collecting, sorting out and preserving local chronicles and regional information documents, developing and utilizing local chronicles resources, and carrying out theoretical research on local chronicles;
(6) Training local chronicles compilers;
(7) Carrying out foreign exchanges and cooperation in the local chronicles work;
Article 6 Organs at all levels, people's organizations, enterprises and public institutions and other social organizations in this Municipality as well as the institutions stationed in Guangzhou directly under the central government or the provincial government shall, in accordance with the local chronicles work plans and tasks of the local people's governments, specify the departments and personnel responsible for local chronicles compilation, participate in the compilation of local chronicles, accept the operational guidance, supervision and inspection of the local chronicles authorities in the local areas, and complete the tasks in accordance with the prescribed time limits and quality standards.
Article 7 The municipal/district local chronicles authority may collect relevant information on the local chronicles from government organs, people’s organizations, enterprises and public institutions as well as other social organizations and individuals, and relevant entities and individuals shall provide support. The municipal/district local chronicles authority may consult, extract and copy the relevant information, but those involving state secrets, commercial secrets or personal privacy shall be handled in accordance with the relevant provisions of the State, provinces and municipalities.
Article 8 The municipal/district people's government shall establish, improve and implement the annual report system for local chronicles in its administrative area.
Article 9 The reporting organization of the annual report of local chronicles shall organize the compilation of the annual report of local chronicles every year, complete the compilation task of the annual report of local chronicles of the previous year before the end of September every year, and report it to the municipal/district local chronicles authority for acceptance.
Article 10 The compilation of local chronicles shall involve experts and scholars in the fields of natural science, humanities and social sciences, and realizing the combination of full-time and part-time personnel when employing staff for local chronicles compilation.
Article 11 The local chronicles compilers shall be responsible, objective, fair and faithful to the facts and historical facts; no entity or individual may instruct expressly or impliedly the compilers to make false descriptions in local chronicles.
Article 12 The local chronicles work shall be based on open amendments and sharing with the public. People from all walks of life are encouraged to participate in the local chronicles work.
Article 13 The compilation of local chronicles shall be subject to quality control in terms of title design, information collection, general compilation, examination and acceptance, publication and distribution, etc.
Article 14 The municipal/district local chronicles authority shall organize relevant authorities, experts, scholars and personnel to comment on the local chronicles of the same level.
Article 15 The compilation of local chronicles shall abide by the laws and regulations of the State on confidentiality and the relevant provisions of the confidentiality authority; if military contents are involved, the relevant provisions of the Central Military Commission on the compilation of military chronicles shall also be observed.
Article 16 Relevant authorities shall invite experts in confidentiality, archives, history, law, economy and military affairs to participate in the acceptance check of local chronicles, and seek their expert opinions. The expert opinions shall be recorded. If the opinions are not accepted, the reasons shall be explained.
Article 17 The local chronicles named after the municipal/district administrative areas and included into the plans can be published only after passing the preliminary examinations, the re-examinations and the final examinations.
Article 18 The compilation of local chronicles and local comprehensive yearbooks named after sub-districts/towns shall be led by the local sub-district offices or town people's governments, and shall accept the operational guidance of the district local chronicles authorities. The sub-district/town local chronicles can be published only after passing the acceptance checks by the district local chronicles authorities; the sub-district/town comprehensive yearbooks can be published only after being approved by the sub-district offices or the town people's governments.
Article 19 The local chronicles and local comprehensive yearbooks named after the district administrative areas shall be filed with the municipal local chronicles authority within 3 months after publication, and the publications and the electronic texts thereof shall be submitted.
Government sectors, trade organizations, social organizations, enterprises and public institutions may compile their own local chronicles and yearbooks respectively. During compilation, they shall accept theoperational guidance of the local chronicles authorities at the corresponding levels based on the affiliation or registration relationship. Within 3 months after publication, they shall file with the local chronicles authorities at the corresponding levels and submit the publications and the electronic texts thereof.
Article 20 The municipal/district people's government shall establish local chronicles museums (rooms) to collect local chronicles and regional information documents and open them to the public free of charge.
Article 21 The municipal/district people's government shall support the informatization construction of local chronicles work and incorporate the construction into its informatization development plan. The municipal/district local chronicles authority shall establish a regional information database and a regional information website. Citizens, legal persons and other organizations may use the above-mentioned information databases and websites to consult and extract local chronicles.
Article 22 The municipal/district people's government or the local chronicles authority shall commend and reward entities and individuals who have made outstanding achievements and contributions to the local chronicles work.
For entities and individuals who donate or provide local chronicles andregional information documents to local chronicles museums (rooms), the municipal/district people's government or the local chronicles authority shall issue collection certificates. For those who have made outstanding contributions, the municipal/district people's government shall issue the certificates of honor.
Article 23 If an institution undertaking the local chronicles tasks commits any of the following acts, the local chronicles work authority shall urge it to make corrections within a time limit; if no correction is made within the time limit, the local chronicles authority shall submit it to the people's government at the corresponding level or its superior authority, and the directly responsible person in charge and other directly responsible personnel shall be punished or dealt with according to law:
(3) Deliberately providing false local chronicles.
Article 24 If individuals intentionally provide false local chronicles, the local chronicles authority shall withdraw their remuneration; individuals suspected of fraud or violation of public security management rules shall be punished by the public security organ in accordance with the Law of the People’s Republic of China on Penalties for Administration of Public Security; if a crime is constituted, criminal responsibility shall be investigated according to law.
Article 25 If the municipal/district local chronicles authority or its staff member commits any of the following acts, the appointment and dismissal organ or the supervisory organ shall punish the directly responsible person in charge and other directly responsible personnel according to law on the basis of their administration power:
(1) Deliberately adding false information to the compilation of local chronicles;
(2) Deliberately damaging local chronicles;
(4) Publishing the draft of local chronicles as a personal work without authorization;
Article 26 If the relevant entities or individuals violate the provisions of Article 11 herein by instructing expressly or impliedly the compilers to make false descriptions in local chronicles, the local chronicles authority at the next higher level shall request the people’s government at the corresponding level to give informed criticism and investigate the responsibilities of the relevant responsible persons.
Article 27 If a local chronicle is found to contain any content against the provisions of the Constitution, laws or regulations after passing the acceptance check and being published, the people's government at the same level or at a higher level shall order to take corresponding measures to correct it, and investigate the responsibilities of relevant entities and individuals as appropriate.
Article 28 The local chronicles authority shall strengthen the supervision and inspection of local chronicles work. If the local chronicles authority finds any illegal compilation and publication of local chronicles, it shall submit it to the publication authority at the corresponding level for investigation and punishment according to law.
Article 29 These Rules shall come into force on January 1, 2012.
