Rules of Guangzhou Municipality on Health Promotion and Education
Article 1 These Rules are formulated in accordance with the provisions of the Law of the People's Republic of China on Basic Medical and Health Care and the Promotion of Health and other relevant laws and regulations, on the basis of the actual conditions of this Municipality and with a view to thoroughly implementing the Healthy China Strategy, strengthening health promotion and education work in this Municipality, improving residents' health literacy and enhancing their health level.
Article 2 These Rules are applicable to the health promotion and education work within the administrative area of this Municipality.
Article 3 Health promotion and education work shall adhere to the principle of prevention in the first place, with people's health as the focus, combined with government leadership, departmental cooperation, public participation and social supervision.
Municipal and district people's governments and government sectors shall take into account health benefits when formulating public policies and establish a mature health impact assessment system, so as to create a comprehensive health support environment.
Article 4 Municipal and district people's governments shall strengthen their leadership in health promotion and education work, include health promotion and education work into the national economic and social development plan, establish a coordinated mechanism, improve the health promotion and education work system and specify the institutions responsible for health education work.
Town governments and sub-district offices shall be responsible for promoting health and education in their respective jurisdictions.
Villagers' committees and residents' committees shall assist town governments and sub-district offices in carrying out health promotion and education work, and organize organizations and individuals within their respective jurisdictions to participate in health promotion and education activities.
Article 5 Health authorities shall be responsible for organizing and implementing health promotion and education work within their respective administrative areas, formulating and implementing health promotion and education work plans at their respective administrative levels and guiding and supervising health promotion and education work within their respective administrative areas. The municipal health authority shall organize and implement these Rules.
The authorities in charge of development and reform, education, science and technology, public security, civil affairs, human resources and social security, planning and natural resources, housing and urban-rural development, transportation, culture, radio, television and tourism, market regulation, sports, port affairs, forestry and landscaping and Internet information shall fulfill their respective duties to promote and carry out health promotion and education work.
Trade unions, Communist Youth League, Women's Federation, Disabled Persons' Federation, Red Cross and other social organizations shall assist governments and relevant government sectors in promoting health and education and organize and mobilize relevant social groups to participate in health promotion and education work.
Article 6 Government organs, public institutions, social organizations, etc. shall establish and improve the health promotion and education work system, specify responsible persons and organize the implementation of health promotion and education work in their own systems and organizations.
Article 7 Health education institutions shall be responsible for the following health promotion and education work under the leadership of the health authorities at their respective administrative levels:
(1)Conduct research in the field of health education, set health education service standards, provide technical guidance and consultation for relevant government sectors and organizations to carry out health promotion and education work and undertake special assessment work for health education services;
(2)Train professionals practicing health promotion and education work;
(3)Produce and publish health communication materials, and establish a mature comprehensive media platform for health communication;
(4)Carry out health education activities tailored to the target population and explore the implementation of intelligent health education practices;
(5)Regularly monitor and evaluate the effectiveness of health education work and adjust communication strategies and health education content promptly.
Article 8 Residents shall fulfill their own health management responsibilities, establish and practice correct health concepts, learn health knowledge, improve health literacy and actively cooperate in implementing basic public health services.
This Municipality advocates family members to learn health knowledge and form a healthy lifestyle that is in line with their own and family characteristics.
This Municipality encourages and supports natural persons, legal persons and unincorporated organizations to support and participate in health promotion and education work through donations, funding, volunteer services or legal establishment of service institutions.
Article 9 The municipal health authority shall establish a health science popularization resource library to provide residents with high-quality health science popularization resource services.
Medical and health institutions shall support their employees in creating health science popularization works and share high-quality health science popularization works in the health science popularization resource library.
Article 10 The municipal health authority shall establish a database of health science popularization experts to provide technical support and professional guidance for the formulation of health science popularization policies, the development of health science popularization information and the dissemination of health science popularization knowledge.
Health authorities shall regularly organize health science popularization experts to give health lectures and consultations in communities, rural areas, schools, enterprises and other places.
News media are encouraged to include health science popularization experts in the review team of health-related TV columns, programs and public service advertisements, so as to improve the quality of health science popularization columns, programs and public service advertisements.
Article 11 The municipal health authority shall establish a professional and authoritative health information platform, include the health science popularization resource library and the database of experts into the management of the platform and establish a sound mechanism for the release and dissemination of health science popularization knowledge in conjunction with relevant authorities to standardize health science popularization knowledge dissemination activities.
The relevant authorities shall use websites, electronic screens in public areas, bulletin boards and their own media to carry out health science popularization knowledge dissemination activities. Public places such as stations, airports, ports, squares, parks, tourist attractions and public sports venues shall promote health education knowledge based on local conditions, and relevant authorities shall strengthen guidance and supervision.
Radio, television, newspapers and online media shall carry out public welfare publicity of health knowledge and disseminate health popularization knowledge to the public.
Article 12 Health information shall have complete and accurate content and reliable scientific evidence, and conform to the progress and consensus of modern medicine. False health information that is inconsistent with facts, lacks scientific evidence, disrupts the order of medical and health management and harms public interests shall not be published or disseminated.
Any organization or individual who discovers false health information may file a complaint or report through channels published on information release platforms, government service hotlines, etc.
For those who use media or public places to carry out health science popularization knowledge dissemination activities, their operators and managers shall review the qualifications of the organizers, the identity of the speakers and the dissemination contents.
Health authorities shall establish a coordination and linkage mechanism with the authorities in charge of education, civil affairs, culture, radio, television and tourism, market regulation, public security, sports, Internet information, etc. to strengthen the collaborative management of health information; if false health information has a certain social impact on this industry or field, the relevant authority shall make clarifications promptly.
Article 13 The third week of October of each year is designated as the Health Education Week in this Municipality.
The municipal health authority shall determine the theme of the annual Health Education Week and organize relevant activities. District health authorities shall carry out health education activities themed by the Health Education Week within their respective administrative areas.
Authorities in charge of health, education, science and technology, culture, radio, television, tourism and sports as well as such organizations as the municipal science and technology association shall organize the implementation of health education activities on health-related hot topics and various health themed days and create a series of brands of health education activities.
Article 14 Grassroots medical and health institutions, hospitals, professional public health institutions and other medical and health institutions shall formulate and implement their own health education work plans, adopt different health education measures for different groups of people and evaluate the effectiveness of their work; shall establish a sound incentive mechanism for health education work, and include relevant work performance into the evaluation for promotion or awards in cases of getting promotions or applying for professional titles.
Hospitals shall provide health education services to patients and their families. Medical and health personnel shall provide health education to patients when providing medical and health services and actively participate in community health education.
Professional public health institutions shall popularize health and disease prevention knowledge, provide health guidance to the public and collaborate with the media to widely disseminate knowledge on disease prevention and control and health care in the process of disease prevention and health care.
Grassroots medical and health institutions shall provide family doctor contract services and carry out health promotion and education activities for key populations, key diseases, major health problems and health risk factors within their respective jurisdictions.
Article 15 The municipal education authority shall improve the health education system for primary and secondary schools and kindergartens, and include the comprehensive improvement of students' health literacy into the comprehensive quality evaluation of middle school students.
Primary and secondary schools shall arrange health education classes, strengthen teacher allocation, ensure that health education is integrated into the entire education process (arrange no less than 6 health education hours per semester in physical education and health courses during compulsory education), and encourage outdoor health education classes. Kindergartens shall integrate health education into children's daily life there.
Article 16 Government organs, enterprises, public institutions, and other organizations shall provide a working environment that is conducive to the physical and mental health of employees, organize fitness activities and psychological care activities for employees, and organize staff health examinations lawfully.
This Municipality encourages government organs, enterprises, public institutions, and other organizations to carry out staff health guidance work, strengthen staff health management and occupational health management team building and enhance occupational health management capabilities.
Employers and relevant government regulatory authorities shall comprehensively improve the occupational health literacy of employees, promote healthy work methods and reduce and control the occurrence of occupational injuries, occupational diseases and other related illnesses.
Article 17 Health authorities shall actively promote the maternal and child health actions focusing on the safety of mothers and infants, the prevention and treatment of birth defects, children's health and the prevention and treatment of breast cancer and cervical cancer.
Each district of this Municipality shall strengthen the construction of one-stop marriage and child care service institutions to provide such centralized services as marriage registration, good prenatal and postnatal care consultation, physical examination, clinical testing, etc. Marriage registration authorities shall assist health authorities in promoting knowledge about marriage and childbirth health when handling marriage registration, and guide both parties to voluntarily accept free premarital and pre-pregnancy health checkups.
Maternal and child health service institutions are encouraged to establish specialized departments for maternal and child health care, including premarital health care, pre-pregnancy health care, pregnancy and childbirth health care, newborn health care and menopausal health care, and carry out popularization and publicity of maternal and child health knowledge.
Article 18 Health authorities shall implement such national basic public health service projects as elderly health management, and regularly provide free health management services such as health assessments, health checkups and health guidance for the elderly. Grassroots medical and health institutions shall strengthen health guidance for common and chronic diseases among the elderly, carry out such health education activities as mental health and disease prevention for the elderly, promote the formation of a healthy lifestyle among the elderly and improve their health literacy.
Civil affairs authorities shall include the health promotion and education work for the elderly into the development plan of elderly care undertakings of this Municipality, supervise and guide elderly care service institutions, elderly activity centers and other organizations to integrate health knowledge popularization and identification of false health products and services into the activities centered on respect for and assistance for the elderly, and enhance the awareness and ability of the elderly to recognize and prevent fraud.
Market regulation authorities shall strengthen the efforts to conduct such health education activities as identifying false health products and services and enhance the awareness and ability of the elderly to prevent and identify false advertising of health products and services.
Residents' committees and villagers' committees shall carry out activities to resist false health products and services and related fraudulent activities for the elderly. The authorities in charge of market regulation, public security, health and civil affairs shall provide guidance.
Article 19 Relevant authorities in charge of health, education, civil affairs, culture, radio, television, tourism, development and reform and science and technology shall strengthen the promotion and dissemination of knowledge on traditional Chinese medicine, establish bases for popularization and publicity of traditional Chinese medicine knowledge and build Lingnan traditional Chinese medicine brands.
Government-run medical and health institutions shall include traditional Chinese medicine knowledge into health education, promote the theory, knowledge and methods of traditional Chinese medicine to the public, and fully leverage the role of traditional Chinese medicine knowledge in enhancing public health literacy. Schools are encouraged to integrate the popularization of traditional Chinese medicine knowledge into primary and secondary education and extracurricular activities.
Article 20 Municipal and district people's governments shall strengthen the construction of various health promotion and education infrastructures. Development and reform authorities shall guide and cooperate with health authorities to carry out relevant project approval and application work. Planning and natural resources authorities shall ensure the land needs for relevant facilities are met. Housing and urban-rural development authorities shall guide and supervise the quality, safety and civilized construction management of housing construction projects.
Science and technology authorities shall organize and implement the identification of health science popularization bases and guide the science popularization bases to carry out health education activities.
Sports authorities shall enhance the level of scientific fitness guidance services, improve the construction of public sports facilities and gradually build 10-minute fitness circles.
Forestry and landscaping authorities shall strengthen the construction of health-themed parks and health trails, so as to create an atmosphere conducive to the physical and mental health of the public.
Article 21 The municipal people's government shall establish a monitoring system for residents' health literacy, evaluate prominent health problems and health needs of residents in this Municipality and include monitoring indicators for residents' health literacy levels into the relevant reform and assessment contents of district people's governments in the field of health.
Health authorities shall regularly organize the monitoring of residents' health literacy, and town governments and sub-district offices shall give assistance.
Health authorities shall use the monitoring results of residents' health literacy to analyze the factors influencing residents' health literacy within their respective administrative areas, and provide scientific basis for formulating and adjusting health-related policies.
Article 22 The municipal and district people's governments shall include the funds for health promotion and education work into their respective government budgets, and ensure the inputs of personnel, development, construction and business funds for professional health education institutions and health promotion work networks in accordance with relevant regulations.
This Municipality encourages enterprises, charitable organizations, foundations, commercial insurance institutions and other social funds to participate in the development of health promotion and education cause, and increase investment through multiple channels.
The authorities in charge of health, education, human resources and social security shall strengthen the standardized construction of the health education talent team, cultivate compound talents, improve the mechanism for assessing and evaluating health education professionals, and ensure the allocation and treatments of relevant personnel.
Article 23 Where an administrative organ or relevant organization and its staff, in violation of these Rules, fail to perform its/his/her duties to health promotion and education in accordance with the law, the competent authority shall order it/him/her to make corrections and impose punishment on the person in charge responsible and other persons directly responsible; if a crime is constituted, criminal liabilities shall be investigated and affixed according to law.
Article 24 Whoever violates the provisions of Paragraph 1 of Article 12 hereof by publishing or disseminating false health information shall be subject to punishment by the industry regulatory authorities within the scope of their respective functions and authorities; if the false health information published or disseminated is false advertising, false promotion, or constitutes unfair competition, it shall be subject to punishment by authorities in charge of market regulation, health and other relevant authorities in accordance with such laws and regulations as the Advertising Law of the People's Republic of China and the Law Against Unfair Competition of the People's Republic of China; if a crime is constituted, criminal liabilities shall be investigated and affixed according to law.
Where the operator or manager violates the provisions of Paragraph 3 of Article 12 hereof by failing to review the qualifications of the organizer, the identity of the speaker and the dissemination contents, resulting in the release or dissemination of false health information, the relevant competent authority shall order it/him/her to make corrections.
Article 25 These Rules shall come into force on January 1, 2025.
