How to Apply for Divorce Notarization

  The divorce notarization is the act carried out by the notary public institute to notarize the legal facts of divorce in accordance with the application of a natural person.


  The divorce notarization can be divided into direct certification (with notarial certificate indicating divorce date, divorce place and names of former husband and wife) and indirect certification (conformity between photocopy and original certificate of divorce, court mediation paper or judgment paper provided by the parties concerned). Different countries or departments may have different requirements. Therefore, it is suggested that you should learn of detailed requirements from the embassy (consulate) deployed by the destination country in China or the department requesting you to provide the notarial certificate prior to handling divorce notarization.


  Special Notes:


  ★ The following list of materials is for reference only as specific materials may be required based on your case and requirements of notaries public.


  ★ The provision of certifying materials shall be originals and corresponding number of photocopies, unless otherwise specified. The photocopies shall be complete and clear and in conformity with the original (as for ID Card, the front and the reverse side shall both be copied).


  The following materials are required for handling divorce notarization based on different circumstances:


  I. Identity materials of the applicant


  ① Chinese mainland citizens shall provide ID Card and household register; applicants who are abroad shall submit photocopy of Passport;


  ② Foreigners shall provide Passport;


  ③ Residents of Taiwan, China shall provide Mainland Travel Permit for Taiwan Residents and ID Card;


  ④ Residents of Hong Kong and Macao, China shall provide Mainland Travel Permit for Hong Kong and Macao Residents and ID Card;


  II. Materials to prove divorce-related facts


  1. Certificate of Divorce issued by marriage registration organ;


  2. Effective Divorce Mediation Paper and Judgment Paper issued by the people's court (the Certificate of Judgment Effect shall also be provided if the case is settled during first instance trial);


  III. Photos: Recently-taken 2-inch bareheaded color ID photos of one person of the party concerned (the required number of photos shall be the number of Notarial Certificates + 1, and the photos shall be of the same version);


  IV. The Power of Attorney and the ID Card of the attorney shall be provided if an attorney is entrusted to make the application.


  V. Other certifying materials deemed necessary by the notary public office.
